Abstract

Uzun yıllar boyunca Osmanlı Devleti’ne başkentlik yapmış olan Bursa adlî, ekonomik, kültürel, siyasi, sosyal ve tarihi olarak her zaman önemli bir şehir olmuştur. Bu tezde Tanzimat’tan sonraki süreçte Mecelle-i Ahkâm-ı Adliyye’nin yürürlüğe girmesi ile adaletin nasıl tevzi edildiğini ortaya koymak için kayıtlardan olan Bursa şer‘iyye sicillerinden C-147 numaralı sicilin 49-97 arası varaklarının transkripsiyonu ve Fıkıh ilmi açısından tasnif ve tahlili yapılmıştır.Tezimiz giriş, üç bölüm ve sonuç kısmından oluşmaktadır. Tezin giriş bölümünde, tezin konusu, önemi, yöntemi ve kaynakları ile şer‘iyye sicillerinin tanıtımına ana hatlarıyla değinilmiştir. Birinci bölümde Bursa Şer‘iyye Sicilleri hakkında genel bilgiler verildikten sonra, tezin konusu olan şer‘iyye sicilinin ilgili kısmı tanıtılmıştır. Yine bu bölümde, şer‘iyye sicilinin ilgili kısmında konu taraması yapılarak tasnif bölümü oluşturulmuştur. İkinci bölümde de dönemin hukuk anlayışına ışık tutan sicil, muhteva itibariyle tasnif kısmında tespit edilip belirlenen fıkhî konular Mecelle-i Ahkâm-ı Adliyye ve Mülteka’l-Ebhur kitabı esas alınarak tahlil edilmiştir. Üçüncü bölümde farklı konular hakkında indekslere yer verilmiştir.--------------------Bursa, which had been a capital of the Ottoman Empire for long years, has always been an important city in terms of economy, culture, politics, social and history. In this study, a registration file number C-147 page 49 to 97 from Bursa Religious Judicial (shar‘iyyah) Records has been transcribed into modern Turkish letters and classified from the point of Islamic Jurisprudence and analyzed. Obviously, this file shows how the juridical organization ensured justice by compilation the Ottoman Code of Civil Law (Majalla-i Ahkam-i Adliyya) after the Tanzimat Reform era in Bursa.Our thesis consists of introduction, three chapters and conclusion. In the introduction part of the thesis, the subject of the thesis, its importance, method and resources, and the promotion of the shery registries are outlined. In the first section, after giving general information about Bursa Şer‘iyye Registers, the relevant part of the sheryiyye registry, which is the subject of the thesis, is introduced. Again, in this section, the classification section was created by scanning the subject in the relevant part of the registry. In the second part, the registry, which sheds light on the understanding of the law of the period, has been determined based on the Ottoman Code of Civil Law and Mülteka'l-Ebhur book based on Majalla-i Ahkam-i Adliyya and Mülteka'l-Ebhur.
