Abstract
Türkiye Avrupa Birliği üyelik müzakereleri sürecinde Avrupa Birliği tarafındanbir şart olarak ileri sürülmesinin ve vize muafiyeti teşvikinin neticesinde TürkiyeAvrupa Birliği Geri Kabul Antlaşması’na taraf olmuştur. Türkiye-Avrupa BirliğiGeri Kabul Antlaşması kapsamında tarafl ar bir diğerinin ülkesinde bulunan düzensizgöçmen niteliğindeki kendi vatandaşları ile kendi ülkesinden karşı taraf ülkeyegitmiş üçüncü ülke vatandaşlarını ve vatansız kişileri geri kabul etme yükümlülüğüüstlenmişlerdir. Türkiye ile Avrupa Birliği arasında yapılan 18 Mart 2016 tarihlizirve sonucunda düzensiz göçle mücadele amacıyla tarafl arın belirli konulardamutabakatını içeren bir bildiri yayınlanmıştır. Bununla birlikte, Türkiye-AvrupaBirliği Geri Kabul Antlaşması’na ve 18 Mart 2016 tarihli zirve bildirisine ilişkin bazısorunlu alanlar bulunmaktadır. Bunlardan birincisi, Türkiye’nin Avrupa Birliği’ninsığınma hukukuna ilişkin düzenlemeleri kapsamında güvenli üçüncü ülke sayılıpsayılamayacağı, bu çerçevede Avrupa Birliği üyesi ülkelerde iltica başvurusundabulunan düzensiz göçmenlerin kabul edilemez başvuru kapsamında Türkiye-AvrupaBirliği Geri Kabul Antlaşması ve 18 Mart 2016 tarihli zirve bildirisi uyarıncaTürkiye’ye iade edilebilip edilemeyeceğidir. Sorunlu alanlardan ikincisi, 18 Mart2016 tarihli zirve bildirisinin hukuki niteliği, uluslararası antlaşma niteliğinde olupolmadığıdır
Turkey became a party to the Turkey-European Union Readmission Agreement_x000D_ as a result of it had been laid down a condition during Europeon Union membership_x000D_ negotiations and also based on visa liberalisation incentive. According to the_x000D_ Turkey-European Union Readmission Agreement the parties are under obligation to_x000D_ readmit their citizens, third country nationals and stateless persons went to other_x000D_ contracting party from their country, who are qualified as irregular migrants. As_x000D_ a result of the Turkey-European Union Summit dated 18 March 2016 a statement_x000D_ was issued by the parties that contain their agreements on certain matters with the_x000D_ aim of combatting irregular migration. However, there are some problematic areas_x000D_ with regard to Turkey-European Union Readmission Agreement and the statement_x000D_ of 18 March 2016. The first problematic area is whether Turkey is qualifed as safe_x000D_ third country according to the European Union refugee regulations and within this_x000D_ framework whether the irregular migrants who made a refugee aplication could be_x000D_ returned to Turkey based on inadmissable application under Turkey-European Union_x000D_ Readmission Agreement and the statement of 18 March 2016. The second problematic_x000D_ area is the legal character of the statement of 18 March 2016, whether it is qualified_x000D_ as an international treaty
