dc.description.abstractBu tez çalışmasında eks!k !ş ve ayıplı !ş kavramlarının tanımları ve farklılıklarını ortaya konulmuş, aynı zamanda bu kavramların hüküm ve sonuçları !le benzer kurumlardan farkları ve eks!k !ş ve ayıplı !ş bakımından karşılaşılan tartışmalı hususlar !rdelenm!şt!r. Ayıplı !ş!n tanımı, hüküm ve sonuçlarına mevzuatımızda farklı kanunlarda yer ver!lm!şt!r. Bununla b!rl!kte, eks!k !şe !l!şk!n mevzuatımızda özel b!r düzenleme bulunmamaktadır. Eks!k !ş konusundak! uyuşmazlıklar genel hükümler uyarınca çözüm bulmaktadır. Ancak eks!k !şe !l!şk!n uyuşmazlıkların oldukça fazla olması neden! !le eks!k !ş özell!kle !çt!hatlar doğrultusunda gel!şm!şt!r. Eks!k !ş ve ayıplı !ş kurumları uygulamada karıştırılab!lmekted!r. Hatta bazı durumlarda b!rb!rler!nden ayırt ed!lmeler! oldukça güç olab!lmekted!r. Bu çalışma !le eks!k !ş ve ayıplı !ş kavramları arasındak! farklılıklar ortaya konulmuş, eks!k !ş!n ve ayıplı !ş hal!nde !ş sah!b!n!n haklarının neler olduğu aktarılmıştır. Konu anlatılırken özell!kle güncel yargı kararlarından ve doktr!ndek! görüşlerden faydalanılmıştır.
dc.description.abstractIn th!s thes!s, the def!n!t!ons and d!fferences of the concepts of !ncomplete work and defect!ve work, as well as the judgments and consequences of these concepts, the!r d!fferences from s!m!lar legal concepts and the controvers!al !ssues encountered !n terms of !ncomplete work and defect!ve work have been d!scussed. The def!n!t!on, judgments and consequences of defect!ve work have been !ncluded !n d!fferent laws !n Turk!sh leg!slat!on. However, no spec!al regulat!on on !ncomplete work ex!sts !n the Turk!sh leg!slat!on. D!sputes regard!ng !ncomplete work are resolved !n accordance w!th the general judgments. However, due to the h!gh number of d!sputes regard!ng !ncomplete work, !ncomplete work has developed espec!ally !n l!ne w!th the case laws. Incomplete work and defect!ve work may be confused !n pract!ce. Moreover, they may even be very d!ff!cult to d!st!ngu!sh from each other !n some cases. In th!s study, the d!fferences between the concepts of !ncomplete work and defect!ve work have been revealed and the r!ghts of the owner !n case of !ncomplete work and defect!ve work have been expla!ned. The current jud!c!al dec!s!ons and the op!n!ons !n the doctr!ne have been part!cularly ut!l!zed wh!le d!scuss!ng the !ssue.
