dc.description.abstractProgram format benzerliklerinden doğan uyuşmazlıkların tüm dünyada üst sıralarda olduğu görülmektedir. Yapımcıların yeterli yasal koruma elde edemedikleri yönündeki eleştirileri ile de formatların eser niteliği, formatların telif hukuku çerçevesinde koruma kapsamı ve iki format arasındaki benzerliğin tespiti noktasında farklı yöntem ve doktrinlerin oluşmasına sağlamıştır. İncelememiz format uyuşmazlıklarının ilk olarak 1930’larda ortaya çıktığı Amerikan ve İngiliz Hukuku özelinde, mahkeme ve doktrin görüşlerini Türk yargı kararları ile mukayese ederek, objektif kriterlerin ve yöntemlerin uygulanmasını önermeyi amaçlamaktadır. Zira incelememiz sırasındaki tespitimiz, yabancı mahkeme kararlarında format benzerliklerinde kullanılan Scènes À Faire doktrinin ve Merger doktrinin uygulanmadığı, formatların arasındaki önemli ölçüde benzerliğin tespiti noktasında objektif yöntemlere yer verilmediği şeklindedir.
dc.description.abstractIt can be seen that the disputes arising from similarities in program formats are at the top of the list all over the world. The criticism of the producers that they cannot obtain sufficient legal protection has led to the formation of different methods and doctrines in terms of the nature of formats as the scope of protection of the formats within the framework of copyright law and the determination of the similarity between the two formats. Our review aims to propose the application of objective criteria and methods by comparing with Turkish judicial decisions the opinions of courts and scholars, in particular in American and English Laws where format disputes first emerged in the 1930s. Our determination during our review is that the Scènes À Faire doctrine and the Merger doctrine, which are used in format similarities in foreign court decisions, are not applied, and that objective methods are not included in the determination of substantial similarity between formats.
