Abstract
Çalışmada İslâm aile hukukunda fesih, talâk ve tefrik kavramları, Hanefî mezhebinin ilk altı yüzyılda kaleme alınan klasik temel eserleri çerçevesinde ele alınmıştır. Çalışmanın amacı fesih, talâk ve tefrik kavramlarının ve bu kavramlar arasındaki ilişkinin ortaya konulmasıdır. Bu nedenle klasik fıkıh kaynaklarında fesih, talâk ve tefrik kavramlarının izi sürülerek Hanefî mezhebinin ilk eserlerinde eşler arası ayrılığa dair yaklaşımın nasıl olduğu tespit edilmiştir. Tez iki bölümden oluşmaktadır. Birinci bölümde nikâh akdini sona erdiren durumlar talâk, fesih, ölüm ve tefrik başlığı altında verilmiş, ayrılık durumlarının hangi ayrılık şekliyle meydana geldiği gerekçeleriyle ortaya konmuştur. İkinci bölümde ise fesih-talâk, talâk-tefrik ve fesih-tefrik kıyaslaması yapılarak birbirleriyle ilişkileri incelenmiştir.
In this study, the terms “faskh, talāq and tafrīq” of Islamic law were examined within the classical Islamic books written in the first six centuries of hijra. The aim of this study is to reveal the relationship between the faskh, talāq and tafrīq. Therefore, the approach to the separation of couples in the early works of Hanafī madhhab was put forth by tracing the meanings of the terms faskh, talāq and tafrīq in the classical fiqh resources. This thesis consists of two main parts. In the first part, the situations ending the marriage were discussed under the heading of talāq, faskh, death and tafrīq. Also, the ways of separation was explained under the question “which situations lead to a separation. In the second part, the relationship of these three terms with each other was introduced by comparing the faskh-talāq, talāq-tafrīq and faskh-tafrīq.
