Abstract
Günümüzde kadının sosyal hayatta daha aktif olarak rol alması, toplumdaki yerinin değişmesiyle birlikte kadın hakkındaki birçok hüküm de yeniden değerlendirilmeye başlanmıştır. Bu bağlamda Nisâ Sûresi 34. âyette yer alan “nüşûz” kavramı ve “nâşize kadın ile ilgili hükümler” de bu değişimle ilişkili olarak günümüzde tartışma konusu olmuştur. Bu çalışmada ilk olarak nikâh akdi hakkında genel bilgi verildikten sonra, söz konusu âyet bağlamında nüşûz kavramı üzerinde durulacaktır. Ardından fakihlere göre kadının hangi durumlarda nâşize sayılacağı konusu ele alınacaktır. Daha sonra kocaya verilen kavvâm sıfatının bir sonucu olarak nâşize kadına uygulanacak yaptırımlar ve kocanın te`dîb hakkı incelenecektir. Nüşûz sebebiyle uygulanacak yaptırımlardan “dövme” tedbiri kadın hakları açısından günümüzde önemli bir tartışma konusu haline gelmiştir. Konuyla ilgili hem klasik hem de modern kaynaklarda yer alan fakihlerin ve müfessirlerin görüşleri ele alınacaktır.
Nowadays with women taking a more active role in social life and changing their place in society, many laws about women have begun to be reevaluated. In this context, the concept of 'nushūz' in the 34th verse of Surah an-Nisa and the 'laws regarding disobedient/ defiant women' have also been the subject of today’s discussion in relation to this change. In this study, after giving general information about marriage agreement, firstly the concept of nushūz in the aforementioned verse will be discussed. Subsequently, cases whereby a woman will be counted as nushūz as accordance to Islamic jurists will be analysed. Then, the sanctions that will be applied to the wife as a result of the title of ‘qawwam' given to the husband and the husband's right to discipline will be examined. The measure of beating, which is one of the actions to be applied due to nushūz, has become an important topic of discussion in terms of women's rights today. Opinions of Islamic jurists and Mufassir in both classical and modern sources on the subject will also be discussed.
