Publication: Türk Medeni Kanunu'nun 163. maddesinde düzenlenen suç işleme ve haysiyetsiz hayat sürme nedenine dayalı boşanma
Abstract
Bu çalışma T.C. İstanbul Marmara Üniversitesi Sosyal Bilimler Enstitüsü’nde olarak hazırlanmıştır. Çalışmamızda öncelikle aile ve evlilik kavramları irdelenmiştir. Akabinde Türk Hukukunda evliliğin sona erme halleri üzerinde durulmuştur. Çalışmamızın devamında Türk hukukunda boşanma kavramı anlatılmış ve boşanma sebepleri hakkında ayrıntılı bilgi verilmiştir. Boşanma sebeplerinin incelenmesinin ardından tez konumuz olan, Türk Medeni Kanunu’nun 163. maddesinde düzenlenen Suç İşleme ve Haysiyetsiz Hayat Sürme sebebiyle boşanma nedenleri ayrıntılı olarak incelenmiştir. Bu bölümde küçük düşürücü suç işleme ve haysiyetsiz hayat sürme sebebiyle boşanma konusu iki aşamada ele alınmıştır. Yargıtay kararlarından ve doktrindeki görüşlerden istifade edilerek küçük düşürücü suç işleme ve haysiyetsiz hayat sürme sebebiyle boşanma halleri diğer boşanma sebepleri ile mukayese edilerek ortaya konulmuştur. Çalışmamızın son bölümünde ise yargılamaya hâkim olan genel usul kuralları ele alınmış, devamında boşanmanın eşler, çocuklar ve mali olmak üzere hukuki sonuçları tez konumuz kapsamında değerlendirilerek çalışmamız sonlandırılmıştır.
This study was prepared as a master’s thesis at the Social Sciences Institute of Marmara University, Istanbul, Republic of Turkey. In our research, the concepts of family and marriage are first examined. Subsequently, the modes by which a marriage may be dissolved under Turkish law are discussed. The study then explains the concept of divorce in Turkish law and provides detailed information on its grounds. Following the analysis of the various grounds for divorce, our thesis topic—the grounds of divorce based on “committing a disgraceful crime” and “leading a dishonorable life” regulated in Article 163 of the Turkish Civil Code—is examined in detail. In this section, divorce due to committing a disgraceful crime and divorce due to leading a dishonorable life are addressed in two stages. With reference to Supreme Court decisions and doctrinal opinions, the cases of divorce on these grounds are presented in comparison with other grounds for divorce. In the final part of our study, the general procedural rules governing the trial are addressed. There after, the legal consequences of divorce—on spouses, children, and finances—are evaluated within the scope of our thesis, and the study is concluded.
