Mütekellimin usulcülerde lafız ve tümel ilişkisi (cem‘u’l-cevami‘ örneğinde)

Abstract

Usul meselelerinin klasik mantık-felsefe diliyle ifade edildiği ve yeniden ele alındığı bir dönemde yaşayan Sübkî, mütekellimîn usul geleneğinin kendisinden önceki birikimini eseri Cem‘u’l-cevâmi‘e taşımıştır. Nitekim söz konusu birikimi mütekellimîn usul düşüncesinde klasik sonrası dönemde ortaya çıkan, Râzî ve Âmidî’ye dayanan iki farklı çizgi üzerinden tevarüs etmiştir. Bu anlamda Sübkî’nin eserinde yer alan lafız-tümel ilişkisi Gazzâlî’den itibaren usul düşüncesine girmekle beraber bu ilişkinin detaylandırılması Râzî ve sonraki dönem usulcüler tarafından gerçekleştirilmiştir.Bu tezde, literatürde tümel kavramıyla ilişkilendirilen âmm lafzın delâleti ele alınmış ve klasik mantığın delâlet şekillerinden hangi delâlet türünün altında yer aldığına dair tartışmalar konu edilmiştir. Bunun yanı sıra mantık-felsefe disiplinine ait tümel kavramının mutlak lafızlar ve emir sigaları bağlamında ne şekilde ele alındığı ve usulcülerin tümellerin ontik gerçekliği üzerinden benimsedikleri nazarî tavrın onların mutlak lafız ve emir sigaları hakkındaki tasavvurlarına nasıl etki ettiği ortaya konulmuştur.

Subkī, who lived in a period when the issues of legal theory was expressed and rehandled within classical logic-philosophy language, reflected the previous accumulation of the theologians tradition to his work Cam‘ al-cavāmi‘. Hence he inherited this accumulation through two streams which emerged in the post-classical period of theologians tradition and originated from Rāzī and Āmīdī. In this sense, although the remarks on relationship between expressions and universals inclueded in the work of Subkī took part in literature for the first time by means of Gazzālī, the legal theorists who elaborated the problem were Rāzī and his successors.In this thesis, the signification of general (āmm) expressions associated with the concept of universal in the literature was tackled and it was examined that these expressions within the scope of which signification type in classical logic take part. In addition, it was revealed that how the concept of universal regarding logic-philosophy discipline have been handled in the context of unqualified (mutlaq) expression and imperative form of the verb (sīghat al-amr) and that how the theoretical attitude of the legal theorists based on the ontic reality of universals has influenced on their conception of unqualified expression and imperative form of the verb.
