İbn Rüşd’ün Bidayeyü’l-müctehid adlı eserindeki tercihleri ve farklı görüşleri

Abstract

İBN RÜŞD’ÜN BİDÂYETÜ’L-MÜCTEHİD ADLI ESERİNDEKİ TERCİHLERİ VE FARKLI GÖRÜŞLERİ Geçmişte fukaha, kaynakları kendi ortamlarına uygun bir şekilde anlamış ve meseleler hakkında ona göre görüşler serdetmiştir. Onların bu görüşleri ya kendi telifleriyle ya da talebelerinin onların görüşlerini derlemesi sonucu günümüze intikal etmiştir. Bu eserlerden kimisi muayyen bir mezhebi, kimisi de mezhep görüşlerinin mukayesesini esas alarak kaleme alınmıştır. İbn Rüşd’ün fıkha dair günümüze ulaşan iki eserinden biri olan Bidâyetü'l-müctehid adlı eseri de mezheplerin mukayesesini esas alan bir eserdir. İbn Rüşd bu eserinde, kendi dönemine kadar tespit edebildiği ihtilaflı meseleleri, bu meseleler hakkındaki görüşleri, ihtilaf sebeplerini ele almış ve bazen kendisi de bu görüşler hakkında yorumda bulunmuştur. Biz de çalışma konumuz olan bu eserde onun yorumlarını esas almak suretiyle müntesibi olduğu mezhebin savunuculuğunun öne çıkıp çıkmadığını, yine kitabında zikrettiği müctehidlerin görüşlerinden farklı görüşlerde bulunup bulunmadığını göstermeyi amaçladık. Kısacası İbn Rüşd’ü kendi kitabında öne çıkarmak istedik. Çalışmamız bir giriş ve üç bölümden oluşmaktadır. İbn Rüşd’ü ve çalışma konumuz olan Bidayetü'l-müctehid adlı eseri tanıttığımız giriş bölümünden sonra birinci bölümde tercih kavramının anlamlarına, İbn Rüşd’ün kullandığı tercih kavramlarına ve bunun örneklerine yer verilmiştir. Bu örnekler, sıkça kullandığı kavramlara ve müctehidlere göre çeşitli şekillerde tasnif edilmiştir. İkinci bölümde İbn Rüşd’ün zikrettiği müctehidlerin görüşlerden farklı, kendine ait görüşleri zikredilmiştir. Üçüncü bölümde ise bu tercih ve farklı görüşlerinde esas aldığı tespit edilen ilkeler incelenmiştir. Çalışma sonunda İbn Rüşd’ün mezhep fıkhı yapmadığı, Mâlikî mezhebi dışında diğer mezheplerin görüşlerinden de tercihte bulunduğu görülmüştür. Görüşleri objektif bir şekilde değerlendiren İbn Rüşd’ün kimi zaman bu görüşler dışında farklı ictihadlarda bulunduğu müşahede edilmiştir.

THE PREFERENCE AND THE DİFFERENT THOUGHTS OF IBN RUSHD İN HİS WORK NAMED BİDÂYETU'L-MUCTEHİD In the past, the fuqaha understood the sources properly in their conditions and given opinion about the cases accordingly to that. Their thoughts in case were transported to present via either their compilation nor collecting their students their thougts. Some of these compilations were written to be predicated on specific sect, the others on the comparison of thougts of sect. Bidâyetu'l-muctehid which is one of the Ibn Rushd’s extant works in the field of Islamic law is based on the comparison of the sects. In this work, Ibn Rushd undertook the controversial cases, the thoughts about these cases, the causes of controversy and sometimes annotated about this thoughts. We aimed in this work to show that if he advocate his sect or not, and if he think different from the muctehids whom thoughts were took place in his book. In brief, we want to highlight Ibn Rushd himself in his book. Our work consists of an introduction and three parts. After the introduction in which we introduced Ibn Rushd and his book, in the first part the meanings of preference, the conception of preference which Ibn Rushd used and the examples of that were took place. These examples were variously assorted to frequently used conception and to muctahıds. In the second part, Ibn Rushd’s thoughts which were different from the others one were mentioned. In the third part, the principles which we found him based on them were examined. In the end of our work, it was seen that Ibn Rushd didn’t make fıqh of sect and he prefered the other sect’s thoughts besides the Malikî’s. On the other hand, it was seen that sometimes Ibn Rushd who evaluated the thoughts objectively made different ictihads from these thoughts.
