Türk sosyal güvenlik hukukunda yaşlılık aylığına hak kazanma koşulları

Abstract

TÜRK SOSYAL GÜVENLİK HUKUKUNDA YAŞLILIK AYLIĞINA HAK KAZANMA KOŞULLARI Sosyal güvenlik sistemleri içinde önemli bir yere sahip olan yaşlılık sigortası, kişilere yaşlılık sürecinde ihtiyaç duyacakları gelir güvencesini sağlayan temel bir araçtır. Bunu sağlayabilmek için sigortalıların sistem tarafından belirlenmiş bazı koşulları yerine getirmeleri gerekmektedir. Ancak yaşlılık aylığından yararlanma koşulları, sürekli değişkenlik göstermektedir. Bunun nedeni ise, prim ödeme ve belli bir yaşa ulaşma gibi koşulların, ülkenin sosyo-ekonomik durumu, demografik yapısı, siyasal ve sivil toplum kuruluşlarının baskıları gibi faktörlerden oldukça etkilenmesidir. Bu hızlı değişim, sosyal güvenlik mevzuatlarını, oldukça karmaşık bir hale getirmektedir. Özellikle ülkemiz gibi farklı sigortalı gruplarının olduğu ve reform niteliği taşıyan yasal değişikliklerin de çok sık gerçekleştiği sistemlerde, bu durum daha belirgin bir biçimde ortaya çıkmaktadır. Bu çalışmada, gerek farklı dönemde çıkarılan yasal düzenlemelere tabi olan sigortalılar gerekse farklı sigortalı grupları için kabul edilen hak kazanma koşulları mukayeseli olarak ele alınmıştır. Böylece sigortalıların ne zaman emekli olacakları sorusunun yanıtına daha kolay ulaşmaları hedeflenmiştir.

THE CONDITIONS TO QUALIFY OLD AGE PENSION IN THE TURKISH SOCİAL SECURİTY LAW Old age pension is a fundamental instrument that takes place in the Social Security systems to supply income security during the old age period of their lives. To obtain this, insured persons have to fulfill the requirements which determined by the Social Security System. Provided that conditions to qualify old age Pension are variable. This is because the conditions like paying the premium and coming to a certain age are relatively affected to the factors of condition of the country'ssocio-economic status, demographicstructure, political and repressionof civil society organizations. This rapid change makes the social security legislations fairly complex. Especially the countries like Turkey that has different insured person groups and has a lot of reforms at the social security law field, can be observed easily. With this study the legislations that enacted at different times about the conditions to qualify old age pension and different insured person groups subjected to the different legislations are comparatively analyzed. Thereby the question of when I retire can be reached more easily by the insured.
