Fikir ve sanat eserleriyle ilgili manevi mali ve bağlantılı hakların ihlali suçları (FSEK m. 71)

Abstract

Tezimizde Fikir ve Sanat Eserleriyle ilgili manevi, mali ve bağlantılı haklara tecavüz suçları incelenmiştir. Telif hakkı sahiplerinin korunması gelişen teknoloji karşısında daha fazla önem kazanmıştır. Fikri bir çabanın ürünü olan eserlerin cezai yönden korunması amacıyla AB müktesebatına da paralel olarak 5846 sayılı Fikir ve Sanat Eserleri Kanunda çeşitli değişiklikler olmuş, cezai yönden koruma için en son 5728 sayılı kanunca değişiklik yapılmıştır. Bu değişiklik Türk Ceza Kanununa uyum amacıyla yapılmıştır. Tezimizin birinci ve ikinci bölümünde eser ve fikri hak kavramları incelenmiştir. Üçüncü bölümde ise fikir ve sanat eserlerinin cezai yönden himayesi kanun sistematiği kapsamında ele alınmıştır. Dördüncü bölümde kısaca yargılama usulüne yer verilmiştir. Tezimizin içinde 5728 sayılı kanun ile yapılan son değişikliklerle ilgili değerlendirmelere yer verilmiştir.

In our thesis about the spiritual ideas and Works of art, financial and related rights violation crimes examined.
