Abstract
İmam Muhammed eş-Şeybânî (v. 189/805), üstadı Ebû Hanîfe’nin vefatından sonraEbû Yûsuf’un kâdı’l-kudâtlık görevini üstlenmesine kadarki süreçte ondan da ilimtahsil etmiştir. Bir ara Medine’ye giderek, İmam Mâlik’in (v. 179/795) ilim halkasınaiştirak etmiş, kaldığı üç buçuk yıl zarfında kendisinden el-Muvatta’ adlı eseridinlemiş ve kendisince sahih gördüğü hadis, sahabe kavli ve uygulamalarınıekleyerek el-Muvatta’ adlı eserini telif etmiştir. Şeybânî’nin bu çalışmasında Hanefimezhebine muhalif bir tercihte bulunup bulunmadığı sorusu her zaman ilimçevreleri tarafından merak konusu olmuştur. Biz de bu çalışmamızda bu soruyacevap bulmaya çalıştık. Musannif’in, fıkıh bablarına göre ele aldığı pek çok meseledeEbû Hanîfe ile aynı kanaati paylaştığı, bazı konularda ise farklı tercihlerdebulunduğunu tespit edilmiştir. Şeybânî, -tespit edilebildiği kadarıyla- on altımeselede Ebû Hanîfe’nin hilafına tercihte bulunmuştur. Çoğunda İmam Mâlik ilemutabık olurken diğer birkaç meselede kendine has bazı tercihlerde bulunduğuortaya çıkmaktadır.
Imam Muhammad al-Shaibani, have collected knowledge from his master Abū_x000D_ Hanīfa until his death and from Abū Yūsuf until he was transferred task of kādı’lkudāt (the head judge). He went to Medina for a while and participated in the_x000D_ scientific community Imam Mālik, and he narrated al-Muwatta’ from him within_x000D_ three and a half years. It was subject of curiosity in the science circles the question of_x000D_ whether Musannıf has made an oppositional preference to the Hanafī school in his_x000D_ work. In this study, we tried to find the answer to this question which is of interest._x000D_ We found that Musannıf shared same opinion with Abū Hanīfa in many issues he_x000D_ dealted them and he work made diffirent choices in some cases. He preferred_x000D_ opposite of Abū Hanīfa in sixteen issues. He agree with Mālik in most issues and he_x000D_ prefers his own thinking in a couple of issues.
