Fikir ve sanat eserleri kanununun 71. maddesinde düzenlenen manevi, mali veya bağlantılı haklara tecavüz suçu

Abstract

2005 yılında 5237 sayılı Türk Ceza Kanunu’nun yürürlüğe girmesi, sonrasında 5846 sayılı kanunla yapılan değişiklikle birlikte 5846 sayılı kanunda düzenlenen “Manevi, Mali veya Bağlantılı haklara tecavüz suçu” gerek kapsamı, gerekse sonuçları açısından birtakım değişikliklere uğramıştır. Çalışmanın ilk bölümünde suçun konusu olan Manevi, Mali ve Bağlantılı haklar kavramı tanımlanmış. İkinci bölümde, inceleme konusu suçun unsurları olan tipiklik, maddi unsur, manevi unsur ve hukuka aykırılık unsuru incelenmiştir. Üçüncü bölümde ise inceleme konusu suçun özel görünüş şekilleri, cezayı ortadan kaldıran sebep olan etkin pişmanlık, soruşturma ve kovuşturma usulü ve yaptırım ele alınmıştır.

After The Turkish Penal Code No: 5237 entry in force in 2005 with the amendment numbered 5846 with law no 5846 held in the law, infringement of the moral, financial, and/ or related rights crime has undergone some changes not only in terms of its results but also in terms of its scope. In the first part of the dissertation the moral, the financial, and/ or related rights concept which is the subject of the crime is defined. In the second part of the dissertation, the typicalness element, the objective element, the subjective element and the element of contradiction of law which are the elements of the crime are reviewed. In the third part of the dissertation the special forms of crime, the effective repentance which remove the crime, investigation and prosecution procedures and sanctions are discussed.
