Abstract
BEŞİKTAŞ H. 1300–1301 TÂRÎHLİ ŞER‘Î MAHKEME SİCİL DEFTERİ’NİN İLMÎ, İCTİMÂÎ VE TÂRÎHÎ BAKIMDAN DEĞERLENDİRİLMESİ, YÜKSEK LİSANS TEZ ÖZETİ. Tezimizin konusu Şer‘î Mahkeme Sicillerinden ( The Judıcıal Regısters ) tek bir Defter’dir. Bu da Beşiktaş H.1300–1301/ M.1883–1884 târîhli Şer‘î Mahkeme Sicil Defteri’dir. Şer‘î Mahkeme Sicilleri, en büyük şehirlerden en küçük beldelere kadar Osmanlı hukûk nizâmının tatbîkâtını gösteren önemli tarihi vesîkâlardır. 19. yüzyılın son çeyreğinin içinde yer alan yılları ihtiva eden Defter, bu dönemin kendine özel zor koşullarına rağmen hukûkun hassasiyetle tatbik edildiğini göstermektedir. İncelediğimiz Defter, Osmanlı Devleti’nin hukûk nizâmı ve bunun tatbikindeki usûl, Osmanlı toplumunun temel taşı olan aile yapısı ve sosyal münasebetler hakkında bilgiler sunmaktadır. Tezimiz giriş ve iki ana kısımdan müteşekkildir. Giriş kısmında Osmanlı hukuk nizamının tanıtılması, birinci kısımda defterin kayıtlı olduğu kazanın tarihi, ictimâ‘î ve iktisâdi bakımdan değerlendirilmesi ve ikinci kısım da ise defter’in transkripsiyonu yer almaktadır. . Thesis subject is only a notebook from The Judicial Registers. This is Beşiktaş H.1300-1301/ M. 1883-1884 dated Judicial Registers notebook. The Judicial Registers is a historical document which indicates ottoman’s law order ivtilization from the biggest cities tothe smallest towns. The notebook which contais the last guarter years of the 19 th. centur law’s ivtilization in spite of this period’s special hard conditions. The notebook we stivdied on presents informations about government’s low ivtilization method and family structure whreh is the ottoman’s basic of soriety and social relations. Our thesis is based upon introduction and two basic parts, in introduction we introduced ottoman’s law order. In the first section the town’s historical , social and economical sitvation is evalvated in which the notebook is registered and in the second section the notebook’s transcription talees place.
