5521 sayılı İş Mahkemeleri Kanunu döneminde
sıklıkla tartışılmış; Yargıtay Hukuk Genel Kurulu
farklı yönde kararlar verdikten sonra asliye ticaret
mahkemelerinin görevli olduğunu kabul etmiş ve
bu görüşünü istikrarlı bir biçimde sürdürmüştür.
Yargıtay’ın iş hukuku uyuşmazlıklarına bakan Daireleri de bu kararlar üzerine iş mahkemelerinin
görevli olmadığına karar vermişlerdir. 7036 sayılı
İş Mahkemeleri Kanunu’nun 25.10.2017 tarihinde yürürlüğe girmesinin ardından da Yargıtay’ın
konuya ilişkin içtihadında bir değişiklik olmamış;
ancak Bölge Adliye Mahkemelerinin konuya ilişkin verdiği bazı kararlarda konunun 7036 sayılı İş
Mahkemeleri Kanunu ve yeni 6102 sayılı Türk Ticaret Kanunu açısından değerlendirilmesi gerektiği, asliye ticaret mahkemelerinin görevli olduğu
görüşünün sürdürülmesinin mümkün olmadığı
belirtilmiştir. Çalışmamızda bu gelişmelere yer verildikten sonra, sözleşme sonrası rekabet yasağına
ilişkin uyuşmazlıklarda iş mahkemelerinin görevli
olduğu, Yargıtay’ın konuya ilişkin içtihadında değişiklik yapılması gerektiği ortaya konulacaktır.
Çalışmanın yayımlanması aşamasında Yargıtay 9.
Hukuk Dairesi de görüşümüz doğrultusunda bir
karar vermiş olup bu içtihadın sürdürülmesi ve
konu gündeminde olan 11. Hukuk Dairesinin de
bu yönde karar vermesi isabetli olacaktır.
The issue to determine the competent court for disputes arising from the post-contractual non-compete obligation of the worker was frequently discussed during the abolished Labour Courts Law No. 5521. After the General Assembly of the Court of Cassation gave different decisions, it accepted that the commercial courts of the first instance were in charge and stably continued this opinion. The Chambers of the Court of Cassation dealing with Labour Law disputes have also decided that the labour courts have no jurisdiction over these decisions. After the Labour Courts Law No. 7036 has entered into force on 25.10.2017, there was no change in the case-law of the Court of Cassation on the subject. However, in some decisions of the Regional Courts of Justice on the subject, the issue should be evaluated in terms of the Labour Courts Law No. 7036 and the new Turkish Commercial Code No. 6102. The Regional Courts of Justice stated that it was not possible to maintain the judgment that the commercial courts of the first instance have jurisdiction. It reveals that labour courts are in charge of post-contractual non-compete disputes. So that change of jurisprudence in the case-law of the Court of Cassation on the subject is necessary. At the stage of publication of the study, the 9th Civil Chamber of the Supreme Court of Cassation also decided in line with our opinion, so it would be appropriate to continue this case law by the 11th Civil Chamber.
