Abstract

PORTFÖY YÖNETİM SÖZLEŞMESİ Ülkemizde ve dünyada, sermaye piyasalarının belirli bir gelişmişlik seviyesine ulaşması ile birlikte, bireysel ve kurumsal yatırımcılar malvarlıklarının yönetimine ilişkin olarak profesyonel destek alma yolunu seçmektedirler. Piyasalarda yaşanan bu değişim sonucu portföy yönetim sözleşmeleri her geçen gün biraz daha önem kazanmaktadır. Bu çalışma ile, portföy yönetim sözleşmesinin hukuki niteliği ortaya konulmaya çalışılmıştır. Bunun için öncelikle sözleşmenin temeli vekalet sözleşmesine dayanan isimsiz bir iş görme sözleşmesi olduğu belirlenmiş ve bu doğrultuda tarafların hak ve borçları açıklanmış, sözleşmenin hangi şartlarla sona ereceği belirtilmiştir.

PORTFOLİO MANAGEMENT CONTRACT In our country’s capital markets and in global capital markets, result of development in markets, individual and establishment ınvestors choose manage their financial assets by help of professionals. As a result of this change in capital markets, importance of portfolio management contracts increase each day. In this study, the legal characteristic of portfolio management contract is tried to determine. Because of this, first of all, the base of the portfolio management contract is determined as an unnamed contract that is based to proxy contract. After that the rights and the obligations of the parties ara explained and in which conditions the contract ends is explained.
