Abstract
Covid-19 bulaşıcı hastalığı, Dünya Sağlık Örgütü tarafından 11 Mart 2020 tarihinde küreselsalgın ilan edilmiştir. Bu salgının yayılım hızını kontrol altında tutmak amacıyla alınantedbirler ülkemizde de birtakım hukuki ve ekonomik sorunu beraberinde getirmiştir. Bunlardanbirisi de; Milli Eğitim Bakanlığı’nın aldığı tedbirler doğrultusunda okulların eğitimfaaliyetlerine örgün şekilde (yüz yüze) devam edememesidir. Covid-19 salgınına karşı alınanbu tedbirlerin ne zamana kadar süreceği ve nasıl devam edeceği belirsiz olsa da, 2019-2020eğitim-öğretim yılına ilişkin hukuki durum netlik kazanmıştır. Nihayetinde 16 Mart 2020’deara verilen örgün eğitime tekrar başlanamamış ve 8 ile 12. sınıflar dışında yüz yüze bir telafieğitimi de mümkün kılınmamıştır. 2020-2021 ilk yarıyılı için ise bazı sınıflarda kademeli veseyreltilmiş olarak 21 Eylül’de başlayan örgün eğitime 20 Kasım 2020-15 Şubat 2021 tarihleriarasında tekrar ara verilmiştir. Bu bağlamda çalışmamız, alınan bu tedbirlerin özel okullarınilkokul, ortaokul ve orta öğretimde akdettikleri kayıt sözleşmelerine eğitim ücreti yönü ileetkisinin hukuki yönden değerlendirilmesinden ibarettir.

The measures taken in an effort to control the spread of this disease has brought along some legal and economic problems in our country as well. One of these problems is that schools cannot proceed their training activities as formal education (face to face). Although it is unclear how long these precautions taken against Covid-19 pandemic will continue and how it will proceed, the legal situation for the 2019-2020 academic year has become clear. Consequently, the formal education interrupted on March 16, 2020 could not recommenced again and remedial training was not provided except 8th and 12th grades. For the first half term of 2020-2021, formal education which started gradually and reduced on September 21 was interrupted again between November 20 and February 15, 2021. In this context, our study consists of legal evaluation of the effect of these measures on the school enrollment contracts concluded by private schools in primary and secondary schools and secondary education.
