Abstract
Mevsimlik iş sözleşmeleri uygulamada sıklıkla akdedilen iş sözleşmesi türlerinden biridir. Fakat bu sözleşme türü, iş ve sosyal güvenlik hukuku mevzuatında açıkça düzenlenmiş değildir. Mevsimlik iş sözleşmeleri belirli veya belirsiz süreli iş sözleşmeleri şeklinde yapılabilirler. Belirsiz süreli mevsimlik iş sözleşmeleri mevsim sonunda askıya alındığında işçinin iş görme, işverenin de ücret ödeme borçları ertelenmektedir. Mevsimlik iş sözleşmesiyle çalışan işçiler hakkında da 6331 sayılı İş Sağlığı ve Güvenliği Kanunu uygulanmaktadır. Ayrıca bu işçiler de sendikalara üye olabilir, toplu iş sözleşmelerinden yararlanabilirler. Sosyal güvenlik hukuku kapsamındaki haklardan, mevsimlik iş sözleşmesiyle çalışan işçiler, sigortalı olma şartını sağlamaları durumunda faydalanabilirler. Mevsimlik tarım işçileri ise kendi istekleri doğrultusunda sigortalı olabilirler. Sigortalı olmadıkları durumlarda bu işçiler ne yazık ki sosyal güvenlik hukuku koruması dışında kalmaktadırlar.
Seasonal employment contracts are one of the types of employment contracts that are frequently concluded in practice. However, this type of contract is not clearly regulated in the labour and social security law legislation. Seasonal employment contracts can be concluded as fixed or indefinite-term employment contracts. When indefinite-term seasonal employment contracts are suspended at the end of the season, worker’s obligation to work and employer’s obligation to payment are postponed. Occupational Health and Safety Law No. 6331 is also applied for workers working with seasonal employment contracts. In addition, these workers can become members of trade unions and benefit from collective labour agreements. Workers working with seasonal employment contracts can benefit from the rights under social security law if they provide the condition of being insured. Seasonal agricultural workers can be insured according to their own wishes. Unfortunately, when they are not insured, these workers are excluded from the protection of social security law.
