Abstract
Tanıklık, ceza muhakemesinde en sık kullanılan delillerdendir. Ancak tanığın insan olması sebebiyle beyanının güvenilirliği tartışmaya açıktır. Çünkü tanık, bilerek yalan beyanda bulunabileceği gibi farkında olmadan yanlış beyanda da bulunabilir. Tanıkların beyanının güvenilirliğinin sağlanabilmesi adına Ceza Muhakemesi Kanunu’nda tanıklığa ilişkin hükümler ayrıntılı bir şekilde düzenlenmiştir. Çalışmanın amacı, Ceza Muhakemesi Kanunu’nda düzenlenen tanıklık hükümlerini, Tanık Koruma Kanunu’nda düzenlenen gizli tanıklık hükümlerini ve çeşitli mevzuatta düzenlenen kırılgan tanıklık hükümlerini ve tanık beyanının güvenilirliğini Yargıtay kararları, Avrupa İnsan Hakları Mahkemesi ve Anayasa Mahkemesi İçtihatları ve Alman hukuku ile karşılaştırmalı bir şekilde ortaya koymaktır.
Testimony is one of the most frequently used evidence in criminal proceedings. However, since the witness is a human being, the reliability of his/ her statement is open to debate. This is because a witness may intentionally make a false statement or may unconsciously make a false statement. In order to ensure the reliability of the witnesses' statements, the provisions regarding testimony are regulated in detail in the Code of Criminal Procedure. The aim of this study is to present the witness provisions regulated in the Criminal Procedure Code, the secret witness provisions regulated in the Witness Protection Law and the vulnerable witness provisions regulated in various legislation and the reliability of the witness statement in a comparative manner with the decisions of the Court of Cassation, the case law of the European Court of Human Rights and the Constitutional Court and German law.
