Publication: Türk Ceza hukukunda uyuşturucu madde suçları
Abstract
Günümüz toplumlarını büyük tehlike içinde bırakan uyuşturucu maddeler, ülkelerin tek başlarına mücadele ettikleri bir meta olmaktan çıkmış, aynı zamanda uluslararası alanda da ortak mücadele edilen bir kavram olarak karşımıza çıkmaktadır. Uyuşturucu maddeler, toplumsal güvenlik ve kamu esenliğine karşı bir tehlike olma yanında, uluslararası terörizmin finans ayağını da meydana getirmektedirler. Uyuşturucu madde ticaretinden elde edilen maddi kazanımlar, ülkelerin ekonomisini tehdit eden bir nitelik kazanmıştır. Bu çalışmanın konusu Türk Ceza Hukukunda uyuşturucu madde suçlarıdır. Türkiye'nin taraf olduğu sözleşmelere kısaca değinilmiştir. Çalışmanın Uyuşturucu Madde Kavramı Denetimi Ve Yasaklanması bölümünde, uyuşturucu madde kavramı açıklandıktan sonra, denetimi için yapılan sözleşmeler kısaca açıklanmıştır. İkinci, üçüncü, dördüncü, beşinci bölümlerde, Türk Ceza Hukukunda olan, uyuşturucu madde temin, uyuşturucu madde kullanılmasını kolaylaştırma suçu, uyuşturucu madde kullanma ve kullanma amacıyla bulundurma suçu ve sahte reçete ile uyuşturucu madde suçları Yargıtay karaları ile desteklenerek anlatılmıştır. Altıncı bölümde, uyuşturucu maddelerin menşeinin tespiti usulü ve müsadere edilen uyuşturucu maddelerin akıbeti açıklanmıştır. Yedinci bölümde, uyuşturucu madde kaçakçılığı ve ülkemizdeki uyuşturucu madde kullanma istatistikleri verilmiştir. Ayrıca istatistik veriler ışığı altında, ülkemizde epidemik karakterde bir hareketin olup olmadığı açıklanmıştır.
Today, many communities have a big dangerous problem about narcotic materials. This problem is not only the special problem for countries, which struggle with narcotic materials, but also this problem is common event for international field. It can be accepted that, public and social security are in danger with the narcotic materials. On the other hand, the main source of international terrorism's finance is provided by the narcotic materials. In economical side, the profit of narcotic materials trade is increasing. This event is starting affect to economy of countries. It can be accepted like threat for countries' economy. The crime of narcotic materials in Turkish Criminal Law is the subject of my thesis. The accepted international agreements by Turkey are mentioned in my thesis. In my thesis, in the chapter of The control of narcotic materials concept and prohibition, narcotic materials concepts are explained and then the subject of agreements for control it is briefly explained. The existence concepts in Turkish Criminal Law, to obtain the narcotic materials, to make usage of narcotic materials easy with laws, usage of narcotic materials and to make available for using it, to buy narcotic materials with counterfeited prescription from pharmacy, all written concepts are explained orderly in the second, third, fourth and fifth chapters. Then, in the sixth chapter, the condition of the confirmed narcotic materials is explained. Finally, the statistical results of persons, who are using narcotic materials in our country, is explained in the seventh chapter.
