Kerhî’nin muhtasar’ının hanefî muhtasar geleneğine etkisi : Kudûrî’nin Muhtasar’ının “icare” bölümü çerçevesinde

Abstract

Kerhî’nin Muhtasar’ının Hanefi Muhtasar Geleneğine Etkisi -Kudûrî’nin Muhtasar’ının “İcâre” Bölümü Çerçevesinde- Muhtasar fıkıh metinleri tüm mezheplerde olduğu gibi Hanefî mezhebi fıkıh tedrisinde de önemli bir yere sahiptirler. Mezheb imamlarından tevarüs edilen zengin ve geniş “mezheb birikiminin” kısa ve

olarak tek bir metinde toplanmış olması sebebiyle tedris faaliyetlerinde tercih sebebi olan muhtasarlar, belli bir dönem sonra “mezheb birikiminin” sonraki nesillere aktarılmasında birinci el kaynaklar haline gelmişlerdir. Bu tezde Hanefî mezhebinde ilk muhtasar müelliflerinden biri olan Irak Hanefî fukahasının merkezî şahsiyeti Kerhî’ye ait Muhtasar isimli eser incelenmiştir. Eserin Hanefi muhtasar geleneği içindeki yeri ve önemini tespit amacıyla söz konusu eser ile yine aynı bölgeden Kerhî’nin üçüncü kuşak talebeleri içinde yer alan Kudûrî’nin Muhtasar’ı şekil ve muhteva açısından icâre bölümü üzerinden karşılaştırılmıştır. Yapılan karşılaştırılma sonucunda Kudûrî’nin -klasik dönem muhtasarları üzerinde etkili olan- Muhtasar’ını telif ederken Kerhî’nin Muhtasar’ından istifade ettiği, böylece Kerhî’nin, Hanefî mezhebi muhtasar geleneğinin oluşumunda Kudûrî üzerinden dolaylı bir etkiye ve bu gelenek içinde önemli bir yere sahip olduğu neticesine varılmıştır. Kerhî, Kudûrî, Muhtasar, Hanefîlik Abstract The Impact of Karkhî’s Mukhtasar on the Hanafî Tradition of Abridgements -with Special Reference to the Chapter of “Ijâra” in Qudûrî’s Mukhtasar- Concise texts in fiqh (mukhtasar) have an important role in Khanafī jurisprudential teaching as they are in all the mazāhib. Mukhtasar’s that have been preferred in the teaching because of the fact that they are the short and concise form of “the mazhab accumulation”, after a certain point in history became the primary sources in conveying “the mazhab accumulation” to the following generations. In this thesis, as a central figure among the Khanafi fukaha of Iraq and as one of the first mukhtasar authors, Kerhī’s Mukhtasar is studied. In order to ascertain the place and time importance of his work among the mukhtasar tradition, from the same region, one of Kerhī’s third generation student, Qudūrī’s Mukhtasar is also studied and compared with Kerhī’s in terms of their ijarah sections. As a result of this comparison, it is concluded that Qudūrī had benefited from Kerhī’s Mukhtasar and by this way, it is seen that Kerhī had an indirect impact on the formation of the mukhtasar tradition in the Khanefi mazhab and had an important place in this tradition by means of Qudūrī.
