Publication: Yüksek askeri şura kararlarının yargısal denetimi
Abstract
Yüksek Askeri Şura kararlarının yargısal denetim haricinde olması, hukuk dev- leti açısından sürekli eleştiri konusu edilmiştir. Anayasa’da 2010 yılında yapılan de- ğişikliklerle bu işlemler yargı denetimi kapsamına alınmıştır. Ancak bu değişiklikle, birtakım işlemler yargı denetimi dışında bırakılmıştır. Esasen denetim dışı bırakılan kararlar, dava konusu edilemeyecek nitelikte kararlardır ve bir kısmı takdir yetkisine ilişkindir. Bu işlemler bakımından ise kararların oluşumu ve yetki konusunda kısıtlı bir denetim alanı mevcuttur. Yüksek Askeri Şura kararlarına ilişkin yapılan değişiklik sonrasında, bu kararların yargı denetimi dışında tutulmasından dolayı hakları ihlal edi- lenlerin hakları iade edilmiştir. Ancak bu hakların iade edilmesi, ihlal edilen temel hak ve özgürlüklerin telafi edildiği anlamına da gelmemektedir. Ayrıca yargısal denetimin Askeri Yüksek İdare Mahkemesi tarafından yapılması da ayrı bir sorun olarak varlığını devam ettirmektedir. Bu çalışmada, Yüksek Askeri Şura’nın yapısı, görevleri, çalışma ve karar alma usulü ele alındıktan sonra, Anayasa değişikliği öncesi ve sonrasında yargısal denetimin kapsamı ve uygulaması ve yoksun kalınan hakların iadesi incelenecektir.
The being outside of judicial review of decisions of the Supreme Military Council, in terms of the rule of law has been constantly subject to criticism. By the amend- ments made in the Constitution in 2010, that decisions were included in judicial re- view. However, by that amendent some decisions are still outside of judicial review. Essantially, decisions which are outside of judicial review are decisions that can not be sued and some of these decisions are related to discretion. These decisions are inside of judicial review about process and authority. After amendent which had been made about decisions of the Supreme Military Council, rights of whose rights were violated by being outside of judicial review of these decisions have been returned. However it does’nt mean that fundamental rights and freedoms which were violated, are com- pensated. Also, it is a different problem that judicial review is being made by High Military Administrative Court. In this study, first Supreme Military Council’s structure, duties, operation and deci- sion-making procedure will be duscussed, thereafter scope and application of judicial review before and after amendment of the Constitution and rights have been returned will be examined.
