Geri dönüş yönergesinin Avrupa adalet divanı tarafından yorumu

Abstract

2008 yılında kabul edilen ve Avrupa Birliği’nde yasadışı göçmenlerin dönüşü ile ilgili hazırlanan yönerge önemli bir adım olmuştur. Böylece “gönüllü dönüş”ü teşvik etme amaçlı ortak bir strateji belirlenmiştir. 2009’dan ATAD`ın yaptığı yorumlar, yabancı ülke uyruklular için umut verici ve koruyucu bir yapıya sahiptir

The directive; adopted in the year of 2008 in relation to the return of the immigrants in the EU; constituted an important step. Thereby, intending to induce the “voluntary return” is determined. The interpretations of the ECJ delivered since 2009 has a promising and protective structure from the point of third countries’ nationals.
