Yapı Kooperatifleri, ortaklarını gayrimenkul sahibi yapmak için kurulmaktadır. Amaç gerçekleştikten sonra yapı kooperatiflerinin hukuki statüsü sonra ermektedir. Fakat sitenin yönetilebilmesi ya da mevcut değerlendirilebilir nitelikteki maddi değerlerin tasarruf ve yönetimine ilişkin olarak hukuki statüsünün ve amacının değiştirilmesi gerekmektedir. Çalışmada bu konuda öneri ve uygulama yer almaktadır. Türkiye de yapılmakta olan yapı kooperatiflerinin amaca ulaştıktan sonra kooperatif üyelerinin mağduriyetlerini doğmasını önlemek amacı ile böyle bir çalışmaya ihtiyaç olduğu düşüncesi haiz olmuştur. Yapılan kaynak taramaları ve saha araştırmaları neticesinde inşaatı tamamlanan yapı koopetiflerinin hukuki statüsünün belirlenmesinde izlenecek yol kendi şartları içerisinde değerlendirilerek sonuca ulaşılması yönündedir. Gerekli sosyal tesisleri bulunan büyük işyeri kooperatiflerinin fesh olarak site yönetim planına göre yönetimini ve hizmetini gerçekleştirmesi zor ve yetersiz olacağından, bu kooperatiflerin işletme kooperatifine dönüşerek faaliyet göstermesi daha uygun düşmektedir. Bununla birlikte yönetimden ziyade ticari bir takım düşünceler ve planlamalar öncelikte ise, anonim şirket olarak faaliyet gösterilmesi, ya da işletme kooperatifi yönetiminin yanında ayrıca bir anonim şirket kurulması uygun düşmektedir. Küçük kooperatiflerde ise, özellikle tek parsel üzerinde yapılaşan ve işyeri yada konut sayısı az olan, sosyal tesisleri bulunmayan kooperatiflerin fesh edilerek site yönetimine geçmesi uygun görülmektedir. After the realization of the goal, the legal status of the building societies expires. But the legal status and the objective should be changed in order to manage and administrate both the building site and existing appraisable property values. In this study, there are sugguestions and implementations about the subject. Such kind of studies are highly needed in Turkey to protect the society members against grievances after the construction. The literature and field researches show that the itinerary of the determination of legal status should be evaluated in thier own terms. Big bussiness cooperatives that have required leisure centers are hard to manage according to building site management plan after the abolishment of the status, so it’s more appropriate to make these cooperatives operate as cooperative enterprises. However, if commercial concerns and plannings are in the foreground rather than the management, it is suggested to operate as joint stock company, or establish a corporation next to the management of the bussiness cooperative. If the building society is smaller –on just one parcel, having few shops or estates, having no leisure centers, it is suggested to abolish the legal status and transfer it to the site management.
