Hukuk muhakemeleri kanunu düzenlemeleri bağlamında hakimin hukuki sorumluluğu

Abstract

Hâkimlerin hukuka aykırı fiillerinden doğan sorumlulukları doğrudan hukuk devleti ilkesinin bir tezahürü olarak hukuk sistemimizde karşımıza çıkmaktadır. Çalışmamızın temel konusunu hâkimlerin yargılama faaliyetlerinden doğan hukuki sorumlulukları ve bu sorumluluğa ilişkin yasal düzenlemelerin temel hak ve hürriyetlerle bağdaşıp bağdaşmadığı hususları oluşturmaktadır. Çalışmamızda hâkimin yargılama faaliyetlerinden doğan hukuki sorumluluğuna dair hükümler güncel mevzuat hükümleri olan 6100 sayılı Hukuk Muhakemeleri Kanunu hükümleri ile daha önce yürürlükte bulunan 1086 sayılı Hukuk Usulü Muhakemeleri Kanunu uygulaması sırasında oluşan yargı içtihatları ve doktrin görüşlerine de yer verilerek karşılaştırma yapılmak suretiyle detaylı olarak incelenmiştir. Bu kapsamda kamu görevlisi tanımı, hâkim kavramının kamu görevlileri arasındaki yeri, hâkimin hukuki sorumluluğuna ilişkin Hukuk Muhakemeleri Kanununda tahdidi olarak sayılan sorumluluk halleri detaylı olarak ele alındıktan sonra hâkimlerin yargılama faaliyetleri sırasında vermiş oldukları zarardan dolayı doğrudan Devlet aleyhine açılacak tazminat davası ve Devletin sorumlu hâkime açacağı rücu davası incelenmiş ve nihayetinde mevcut Hukuk Muhakemeleri Kanunu düzenlemeleri ile ilgili olduğunu düşündüğümüz temel hak ve hürriyetler hâkimin hukuki sorumluluğu konusu çerçevesinde ele alınmıştır.

The liabilities of judges arising from their unlawful acts are directly encountered in our legal system as a manifestation of the principle of the rule of law. The main subject of our study is the legal liabilities of judges arising from their trial activities and whether the legal regulations regarding this liability are compatible with fundamental rights and freedoms. In our study, the provisions regarding the legal liabilities of judges arising from their trial activities are examined in detail by comparing the provisions of the current legislation, the Code of Civil Procedure No. 6100, with the judicial precedents and doctrinal opinions formed during the implementation of the Code of Civil Procedure No. 1086, which was in force before. In this context, after the definition of public officer, the place of the concept of judge among public officers, and the liability situations listed as limited in the Code of Civil Procedure regarding the legal liability of judges were discussed in detail, the compensation lawsuit to be filed directly against the State due to the damage caused by judges during their trial activities and the recourse lawsuit to be filed by the State against the responsible judge were examined and finally, the fundamental rights and freedoms that we think are related to the current Code of Civil Procedure regulations were discussed within the framework of the legal liability of the judge.
