IV.-VI. (X.-XII.) asırlarda Şâfiî mezhebinde fetvâ faaliyeti ve kaynakları

Abstract

Bu çalışma, IV.-VI. (X.-XII) asırlarda Şâfiî mezhebinde fetvâ faaliyetini tarihî seyri içinde ortaya koymak amacıyla dönemin müftîlerini ve fetvâ eserlerini konu edinmektedir. Erken dönem Şâfiî mezhebi iftâ tarihinde, müftî olarak temayüz eden birçok fakihin bulunduğu, bu fakihlerin ağırlıklı olarak mezhep hâkimiyetinin güçlendiği Irak ve Horasan bölgelerinde yaşadıkları, buna bağlı olarak adı geçen bölgelerde iftâ faaliyetinin diğer bölgelere nispetle daha yoğun seyrettiği anlaşılmıştır. Bölgelerde iftâ faaliyetlerinin sayı ve yoğunluğunda, başta eğitim olmak üzere bir takım sosyo-kültürel ve siyasî sebeplere bağlı olarak değişiklikler yaşandığı görülmüştür. İftâ faaliyeti, kahir ekseriyeti mezhep temsilcisi olan fakihler tarafından yürütülmüş; bu bağlamda müftîlerin, ilmi yetkinliğe sahip dönemin önde gelen Şâfiî âlimleri oldukları anlaşılmıştır. Dönemin müftîlerinin, iftânın yanı sıra tedris ve münazara konularında da aktif rol alarak mezhebin yayılmasında ve istikrar bulmasında büyük katkılar ortaya koyduğu görülmüştür. Şâfiî literatürü kapsamında en erken tarihli fetvâ eserinin, hicrî dördüncü asırda yaşamış Mısırlı müftî fakih İbnü’l-Haddâd el-Kinânî’nin (ö. 344/ 955) Fetâvâ’sı olduğu tespit edilmiştir. Dönemin günümüze ulaşan diğer altı fetvâ eseri üzerinden yapılan incelemede, tasnif bakımından bir kısmında Müzenî’nin el-Muhtasar’ının örnek alındığı, fetvâların ağırlıklı olarak muâmelât konularıyla ilgili olduğu, üslûp itibariyle aralarında kısmî farklılıklar bulunduğu ve dil üzerinde coğrafî etkilerin görüldüğü belirtilmelidir.

This study deals with the Shāfi‘ī muftīs who lived in 4th and 6th century AH and the fatwā collections which attribute them to reveal the historical course of the fatwā activity in the Shāfi‘ī school at that period. It is understood that in the early period of the Shāfi‘ī school, many fuqaha stand out as muftī and these fuqahā mainly lived in Iraq and Khorasan regions where the school dominance was strong. Therefore, iftā activity has been experienced more intensely in these regions compared to other regions. Besides that, in these regions, there was no same intensity of iftā activity in every period. It has been observed that this situation has some socio-cultural and political reasons, especially education. The iftā activity was carried out by the fuqahā, most of whom were representatives of the school. In this context, it was understood that the muftīs were the leading Shāfi‘ī scholars of the period who had scientific knowledge. Within the scope of the Shāfi‘ī literature, it has been determined that the earliest fatwā collection is the Fatāwā Collection of Ibn al-Haddād who was the Egyptian muftī-jurist who lived in the 4th century AH. In the examination made over the other six fatwā collections of the period, it is seen that the al-Mukhtasar of al-Muzenī was part of taken as an example in terms of classification. The content is predominant in the subjects of al-muāmalāt, there are minor differences between them in terms of method and the geographical effects on the language are noticed.
