Abstract
FİL-MEHÂKİMİ’Ş-ŞER’İYYETİ’L-FİLİSTÎNİYYE FİLİSTİN ŞER'İ MAHKEMELERİNDE EŞLER ARASINDAKİ UYUŞMAZLIKLARIN ÇÖZÜMÜNDE TAHKİM Eşler arasında tahkim, evlilik anlaşmazlıklarının çözümünde yargıya alternatif bir kurumdur. Tahkim, daha az zamana ve maddi külfete ihtiyaç duyması, daha hızlı uygulanması, sürecin gizli yürümesi, akraba ve hısımlar arası iyi ilişkilerin korunması ve toplumsal istikrar ve mutluluğu desteklemesi açısından faydalı bir uygulamadır. Bu nedenle, Filistinli aileler genelde mahkemelere başvurmak ve dava açmak yerine eşler arasındaki anlaşmazlıkların çözümünde tahkim yoluna gitmektedirler. Biz bu çalışmamızda, Filistin Şer’i Mahkemelerinde eşler arasındaki anlaşmazlıkların çözümü için uygulanmakta olan tahkim kurumunun mahiyetini ortaya çıkarmak için bu kurumun hukuki ve şer’i referanslarını açıklamak, Osmanlı Aile Hukuku Kararnamesi ve Ürdün hukuku ile güçlü bağlantılarını ortaya çıkarmak ve hakemlerin koşulları, görevleri, görevden alınma nedenleri ve tercih edilme yöntemlerini belirlemek amacıyla, fıkıh ve hukuk kitaplarını inceleyerek ve araştırmaya dayalı analitik betimsel metodoloji ile tahlil etmeye gayret ettik. Araştırmamızla, eşler arasındaki anlaşmazlıkların çözümünde uygulanan tahkim hususunda Filistin özelinde fıkhi ve hukuki temellendirilmesi ve bu konudaki görüşlerin klasik fıkhi yaklaşımlarla uygunluk boyutunun tespiti yanında Filistin şer’i mahkemelerinde tahkimin uygulamalı modellerini sunarak; tahkimin pratikte uygulama yöntemini ortaya koymayı hedefledik.
Arbitration Between Spouses in the Palestinian Sharia Courts Arbitration between spouses is an alternative institution for the judiciary in resolving marital disputes. It helps shorten the time, requires fewer material costs, swiftness in completion, confidentiality in work, maintains good relations with relatives and in-laws, and supports social stability and happiness. Therefore, Palestinian families often resort to it instead of reviewing the courts and opening cases. We tracked and studied legal texts and literature in this research following descriptive, inductive, and analytical approaches. The goal of this study is to clarify the concept of arbitration between spouses in Palestinian law, to clarify the legal and Islamic Sharia reference for this institution and its close relationship to the Ottoman family rights law and Jordanian law, and to know the conditions of the two arbitrators, their tasks, the reasons for their dismissal, and the method of their selection. The methodology of this study is based on the arbitration in Palestinian sharia courts. It first explains the Sharia and legal basis of arbitration between spouses and then, by declaring the Sharia view on all texts in Palestinian law regarding arbitration between spouses, it determines the compatibility dimension of Palestinian arbitration practices with the past rules of Islamic Sharia.
