FUKAHÂ METODUNA GÖRE YAZILAN FIKIH USÛLÜ ESERLERİNİN TEMEL ÖZELLİKLERİ Dünyada hiçbir hukuk sisteminde tam bir karşılığı olmayan fıkıh usûlü ilmi, İslâm hukukuna ve Müslümanlara has orijinal bir ilim dalıdır. Günümüz İslâm hukukçusunun bilmesi ve derinliğine vâkıf olması beklenen bu ilmin henüz gereken ölçüde incelemeye tâbî tutulduğu ve her yönüyle aydınlatıldığı söylenemez. Bir ilim dalının temel yapısını ve gelişim sürecini tespit etmenin en geçerli yollarından birisinin, bu ilimle uğraşanların ortaya koydukları literatürü tanımak olduğu ifade edilebilir. İbn Haldun (v. 808/ 1406)'la birlikte fıkıh usûlü ilmine ait literatürünün fukahâ metodu, mütekellimîn metodu ve bu ikisinin birleşiminden oluşan memzûc metot olmak üzere üç temel kategoriye ayrılarak ele alındığı görülür. Fıkıh usûlü literatürüne yönelik bu kategorilerden birisi olan fukahâ metodunun incelenmesinin amaçlandığı bu tezin birinci bölümünde, ilgili kaynaklarda fukahâ metoduna yönelik tasavvurların neler olduğu ortaya konulmaya gayret edilmiştir. İkinci bölümde, fukahâ metodu ile yazılan eserleri örneklendirme amacıyla yaygın bir şekilde verilen Cessâs (v. 370/ 980), Debûsî (v. 430/ 1038), Pezdevî (v. 482/ 1089) ve Serahsî (v. 483/ 1090)'nin usûl eserleri esas alınarak fukahâ metodunun karakteristik yapısı tespit edilmeye çalışılmıştır. Bu amaçla, söz konusu eserler muhtevâ, konuların tasnif sistemi ve işleniş yöntemi, usûlün inşâsı ve ana ekoller olmak üzere değişik açılardan incelemeye alınmış, elde edilen neticeler, deliller ve örnekler eşliğinde değerlendirmeye tâbî tutulmuştur. Ayrıca fukahâ metoduna yönelik tespit ve değerlendirmelerde esas alınan eserlerin muhtevâlarını sistematik bir şekilde gösteren bir çalışma, tezin sonunda ek olarak verilmek suretiyle söz konusu eserlere genel bakış yapabilme imkanı sağlanmıştır. Sonuç olarak, usûl ilmine ait literatür açısından önemli bir konuma sahip olan fukahâ metodunun karakteristik yapısı, bu metot ile ilgili tasavvurları da test eder mahiyette, kapsamlı bir bakış açısıyla ortaya konulmuştur. Yet it is impossible to say that this discipline, which is a prerequisite for the students of Islamic law, has received the attention it deserves. It can be said that the most important way of exploring the basic structure and evolution process of a discipline is to analyze the literature produced by those who specialize on that discipline. Ibn Khaldun (d. 808/ 1406) analyzed Usul al-Fiqh by dividing its literature into three categories from the perspective of the methods used in it: those who follow the method of jurists, those who follow the method of theologians and those who combine both methods. The goal of this thesis is to analyze the method of the jurists. The first chapter looks at the perspectives on the method of jurists in the relevant literature. The second chapter explores the characteristics of the method of jurists by looking at the work of such jurists as Jassas (d. 370/ 980), Dabusi (d. 430/ 1038), Bazdawi (d. 482/ 1089) and Sarakhsi (d. 483/ 1090). The works of the aforementioned scholars are analyzed from the perspective of content, the order and analysis of topics, construction of methods and the major schools. The findings are presented and evaluated by examples and evidences. In addition in the appendices of the thesis, the contents of the works on the method of jurists are systematically presented to allow the reader obtain a general look at them. In conclusion, the characteristic structure of the jurists method is presented. At the same time, the conventional views on the method of jurists in the existing literature are tested and evaluated with a critical approach.
