Türk Hukuku'nda Bilinci Açık Hastanın Tedaviyi Ret Hakkının Tıp Hukuku ve Etiği Açısından İncelenmesi ve Tıp Etiği

Abstract

Tedaviyi ret hakkı bireyin kendisine gerçekleştirilebilecek tıbbi uygulamalar konusunda bilgilendirildikten sonra bu uygulamaları ret edebilmesini içerir. Bu hak, bireyin yaşamı ve beklentileri konusunda karar alabilmesi açısından önemlidir. Ancak tedaviyi ret hakkının kullanılmasının hastanın ölümü ile sonuçlanacağı durumlarda tedaviyi ret hakkının sınırları ile ilgili tıp etiği ve hukukunda yoğun tartışmalar bulunmaktadır. Makalemizde Türk hukukunda yer alan, tedavinin reddine ilişkin hükümler tıp etiği ve hukuku açısından incelenmiş ve bu hükümlerin tedaviyi ret hakkına etkileri tartışılmıştır. Kişinin tedavinin reddi konusunda karar veremeyecek durumda olduğu durumlar çerçeve dışında bırakılmıştır.

The right to refuse treatment involves the choice of refusing treatment after being informed about the recommended medical interventions. This right is signifi cant in that it enables the individual to make his decisions based on his life and his expectations. However, there is intense controversy with regard to the limits of the right to refuse treatment in Turkey in the fi elds of medical ethics and medical law. In this article, the provisions of Turkish law concerning the right to refuse treatment are examined and the effects of these provisions on this right are discussed. Situations where the person is not able to decide for herself/himself have been excluded from the discussion.
