Abstract

ASKERİ CEZA KANUNU’NDA ÖLÜMLE SONUÇLANAN NETİCESİ SEBEBİYLE AĞIRLAŞMIŞ SUÇLAR Türk Ceza Kanunu’nun 23. maddesinde neticesi sebebiyle ağırlaşmış suçlar “Bir fiilin, kastedilenden daha ağır veya başka bir neticenin oluşumuna sebebiyet vermesi halinde, kişinin bundan dolayı sorumlu tutulabilmesi için bu netice bakımından en azından taksirle hareket etmesi gerekir.” şeklinde tanımlanmıştır. Bu terim Askeri Ceza Yargılamasında da kullanılabilmektedir. Bu tezde, ölümle sonuçlanan üç suç tipi açıklanmaya çalışılmıştır. Askeri Ceza Kanunu’nda daha başka ölümle sonuçlanan suç tiplerine rastlanmaktaysa da bunların arasından özellikle kasten yaralama sonucu oluşan suç tipleri açıklanmaya çalışılmıştır mle Sonuçlanan Neticesi Sebebiyle Ağırlaşmış Suçlar, Askeri Ceza Kanunu

THE AGGRAVATION OF AN OFFENCE DUE TO ITS CONSEQUENCES, WHICH ARE DEATH ENDED, IN MILITARY PENAL CODE The aggravation of an offence due to its consequences is termed as “where act couses more serious results, or result other than intended, a person will not be culpuble unless he has actede, at least, with recklessness in regard to such act” in Turkish Penal Code, article 23. This term also can be used in Military crimes. Declination the three of military crimes that resulted in the death is tried in this thesis. Although there are many crimes that resulted in the death, the crimes, especially, amoung the intentionaly injury crimes are selected.
