UYUŞMAZLIK ÇÖZÜMÜNE LLEWELLYN'İN GÖZÜNDEN BAKMAK: HUKUK UĞRAŞLARI KURAMI

Abstract

Alternatif uyuşmazlık çözümü (AUÇ) modern devletin yargı faaliyeti ile şiddet ya da kaçınma gibi geleneksel yöntemlerin dışında kalan uyuşmazlık çözüm mekanizmalarına işaret eden genel bir kavramdır. AUÇ 1960ların Amerikasında, yargıçların aşırıya kaçan yüklerini hafifetmek ve dava sayısını azaltmak için devlet tarafından oluşturulan bir dizi kolaylaştırıcı yöntemdir. Bir vakit sonra diğer ülkelere ve dahi Türkiyeye de yayılmıştır. İlgili yöntemler yargı sisteminin sorunlarına yönelen pratik çareler oldukları için, tutarlı bir kuramsal temelden yoksundur. Bu makaleye göre, Karl Nickerson Llewellyn tarafından ortaya atılan hukuk uğraşları kuramı bu sorunu aşmak için yeterli bir çözüm sunabilir. Takip eden sayfalarda hukuk uğraşları kuramının temel nitelikleri, özellikle önemli bir hukuk uğraşı olarak sorunların giderilmesi, incelenecektir.

Alternative dispute resolution (ADR) is a general concept which addresses to the dispute resolution mechanisms apart from the modern state s judiciary function or traditional methods like violence or avoidance. ADR was constituted by state as a group of facilitative devices for to relieve the overwhelming burden of judges and to decrease the number of cases in 1960s America. After a while it has spread to the other countries and so to Turkey. Since the alternative methods are practical remedies for the problems of judicial system, they are deprived of a consistent theoretical foundation. According to this paper, the law jobs theory asserted by Karl Nickerson Llewellyn can ofer a suficient solution for overcoming this problem. Te main features of law jobs theory, especially disposition of trouble cases as a substantial law job, will be examined in following pages.
