dur, Mağdurun Korunması ÖZET CEZA HUKUKUNDA MAĞDUR VE MAĞDURUN KORUNMASI Ceza hukukunda mağdur ve suçtan zarar gören, geçmiş uygulamalar çerçevesinde bir tanık ve hatta muhakemenin unutulan bir süjesi olarak görülmekteydi. Konu hakkında uluslararası alandaki çalışmalar ve özellikle 5271 sayılı Ceza Muhakemesi Kanunu ile mağdur ve suçtan zarar gören muhakeme faaliyetleri bakımından çeşitli haklarla donatılmışlar ve kendilerine tanınan bu haklar sayesinde muhakeme faaliyetlerine katılan, görüş bildirme hakkı tanınan bir konum kazanmış olmaktadırlar. Bu sayede mağdur ve suçtan zarar görenin hukuki güvenliğinin sağlanması ve adalete katılım süreçleri beraberinde bir bütün oluşturmuş bulunmaktadır. Bununla beraber bu kişilere manevi yönleri ağırlık basan uygulamaların tanınması ve bu uygulamalardan etkin ve sürekli olarak yararlanmaları ihtiyaçlarının giderilmesi konusunda bir çözüm olabilecektir. Çalışmamızda, ilk olarak mağdur kavramı ve mağdur kavramının içerikleri incelenmiş, mağdur kavramının benzer kavramlardan farklarına değinilmiş, mağdurun kavramının tarihi gelişimi beraberinde uluslararası hukuk bakımından mağduriyetin önlenmesine ilişkin uygulamalar ile ceza hukuku bakımından mağduriyetin giderilmesine yönelik kurumlara yer verilmiş ve son olarak mağdur ve suçtan zarar görenin ceza muhakemesi yönünden hakları incelenmeye çalışılmıştır. THE CONCEPT OF VICTIM AND PROTECT OF VICTIM UNDER CRIMINAL LAW At criminal law, victim and the person who has suffered from a crime, considered as a witness within the scope of old practices and even a disappearing subject of trials. Studies on the subject in the international arena and especially with the criminal procedure law no. 5271, the victim and tancy trial activities are equipped with variety of rights and by means of these rights they earn a position that allows participating to trial activities and talkback right. Thus, ensuring the legal security and participation to justice of the victim and the person who has suffered from a crime has created a whole. Therewithal, recognition of spiritually overweighted practices to these people and to fulfilling the need of benefit from such practices continuously and effectively may be an answer to all these matters. In our study, first we have analyzed the notion of victim and contents of this notion, then we have mentioned the differences between notion of victim and similar notions. Continued on with historical development of victim notion, followed by practices for the prevention of victimization in terms of international law, including institiutions that operates elimination of victimization in terms of criminal law and finally rights of the victim and person who has suffered from a crime are examined in terms of criminal procedure law.
