Sermaye şirketlerinde iflasın ertelenmesi

Abstract

“Sermaye Şirketlerinde İflasın Ertelenmesi” borca batık bir sermaye şirketinin olası bir iflas kararına karşı mahkemece belirlenecek şartlara göre kanunda belirtilen süreler içerisinde şirketin iyileştirme projesi kapsamında iflasın mahkeme tarafından ertelenmesi ile borca batık durumda bulunan şirketin mali durumunun iyileştirilmesini amaçlamaktadır. Üç ana bölüme ayrılan “Sermaye Şirketlerinde İflasın Ertelenmesi” tez çalışmasında birinci bölümde, iflasın ertelenmesi kavramı ve amacı, ikinci bölümde iflasın ertelenmesinin koşulları, üçüncü ve son bölümde ise iflasın ertelenmesi talebi hakkında verilen kararlar incelenmiştir. “The Postpone Of Bankruptcy In Capital Companies” aims at improving the financial state of the company, which is in state of deep in debt, by postponing the bankruptcy by the Court within scope of improving the company project in the period of times set forth under the laws in pursuant to the conditions to be determined by the Court against a probable decision of bankruptcy regarding the corporation deep in debt. In the thesis study of “The Postpone Of Bankruptcy In Capital Companies”, which is divided into three main groups, under the first section, the concept and the purpose of postponement of bankruptcy; under the second section, conditions of postponement of the bankruptcy and under the third and the last section, the decisions regarding the request of postponement of the bankruptcy has been analyzed.
