Türk Medeni Kanunu'nda hapis hakkı

Abstract

Hapis hakkı, çeşitli kanunlarda düzenlenmiş bir kavram olup, çalışmamızda Türk Medeni Kanunu’nun 950-953. maddeleri arasında düzenlenmiş olan genel hapis hakkı kapsamlı olarak ele alınmıştır. Bu çalışma giriş bölümü hariç dört bölümden oluşmaktadır. Birinci bölümde hapis hakkı kavramından, hapis hakkının hukuki niteliğinden ve benzer hukuki kurumlarla karşılaştırılmasından bahsedilmiştir. İkinci bölümde hapis hakkının konusu ve şartları anlatılmıştır. Bölüm sistematiği oluşturulurken, hapis hakkının konusu hapis hakkının bir şartı olarak değerlendirilmiştir. Üçüncü bölümde hapis hakkının kullanılması ve hükümlerinden bahsedilmiştir. Dördüncü bölümde hapis hakkının temliki ve sona ermesi ele alınmıştır. Sonuç bölümünde ise hapis hakkı, Türk Medeni Kanunu kapsamında değerlendirilmiştir.

Right of lien is a concept, were issued in various laws. General right lien were issued between articles 950-953 of the Turkish Civil Code, has been extensively addressed in our thesis.This study consists four part except introduction.In the first chapter, the concept of right of lien, the nature of right of lien and comparison with the similar juridical institutions are mentioned.In the second part,the subject of right of lien and conditions of right of lien are axplained. In creating the department system, the subject of right of lien has been evaluated a condition of right of lien. In the third chapter, using of right of lien and the provisions of right of lien are mentioned.In the fourth chapter, assignment of right of lien and expiration of right of lien has been addressed. In the conslusion section, right of lien within the scope of Turkish Civil Code are analysed.
