Abstract
Bu çalışmada, diş hekimliği mesleğinde meydana gelen malpraktis olguları incelenmiş ve diş hekimi ile hasta arasındaki ilişkinin hukuki boyutu ele alınmıştır. Diş hekimlerinin tıbbi müdahaleleri, kişinin bedenine doğrudan müdahale niteliği taşıdığından, bu müdahalelerin hukuka uygun sayılabilmesi için belirli şartlar gerekmektedir. Diş hekimi ile hasta arasındaki hukuki ilişki, sözleşme ilişkisi, haksız fiil ilişkisi ve vekaletsiz iş görme ilişkisi olarak değerlendirilmiş; bu ilişkilerin şartları ortaya konmuştur. Diş hekimi ile hasta arasında kurulan sözleşmenin türü, hizmet, eser, sui generis veya vekalet sözleşmesi olabilir. Çalışmamızda, diş hekimlerinin özel hukuk sorumlulukları üzerinde durularak Türk Borçlar Kanunu, Sağlık ve Tıp Hukuku Mevzuatı ve Yargıtay kararları doğrultusunda değerlendirmeler yapılmıştır. Çalışmanın ilk bölümünde tıbbi müdahale kavramı, aydınlatma ve rıza unsurları ele alınmıştır. İkinci bölümde malpraktis kavramı tanımlanmış, komplikasyon kavramıyla farkı ortaya konmuş ve diş hekimliğinin çeşitli bölümlerinde görülebilecek malpraktis vakaları Yargıtay kararlarıyla örneklendirilmiştir. Son bölümde, diş hekimi ile hasta arasındaki ilişkinin hukuki sebepleri ve şartları incelenmiş, tedavi sözleşmesi kapsamındaki hak ve yükümlülükler detaylı olarak ele alınmıştır. Çalışma, diş hekimlerinin hukuki sorumluluklarını ve tıbbi uygulamalardaki yükümlülüklerini ayrıntılı bir şekilde ele alarak uygulayıcılara ve hukukçulara yol göstermeyi amaçlamaktadır.
In this study, malpractice cases occurring in the dental profession were examined and the legal dimension of the relationship between the dentist and the patient are discussed. The medical interventions of dentists involve direct intervention on a person's body, therefore, certain conditions must be met for these interventions to be considered lawful. The legal relationship between the dentist and the patient has been evaluated as a contractual relationship, a tort relationship and a relationship of acting without authority; the conditions of these relationships have been outlined. The type of contract established between the dentist and the patient can be a contract for services, a contract for a specific work, a sui generis contract, or a contract of agency. In our study, the special legal responsibilities of dentists have been emphasized, and evaluations have been made in accordance with the Turkish Code of Obligations, Health and Medical Law Legislation, and decisions of the Court of Cassation. In the first section of the study, the concept of medical intervention, information and consent elements were discussed. In the second section, the concept of malpractice has been defined, the difference with the concept of complication has been highlighted, and malpractice cases that may occur in various branches of dentistry have been exemplified with Court of Cassation decisions. In the final section, the legal grounds and conditions of the relationship between the dentist and the patient have been examined, and the rights and obligations within the scope of the treatment contract have been discussed in detail. The study aims to address the legal responsibilities of dentists and their obligations in medical practices in detail, with the goal of providing guidance to practitioners and legal professionals.
