Publication: Uyuşturucu veya uyarıcı madde ticareti suçları (TCK md 188/ 3)
Abstract
Uyuşturucu veya uyarıcı madde ticareti suçları, küresel çapta karşılaşılan enbüyük sorunlardan birisini oluşturmaktadır. Her geçen gün artan kullanım talebinikarşılamaya yönelik oluşan uyuşturucu ve uyarıcı madde arzı, illegal bir ticareti ortayaçıkarmıştır. Zararlı etkileri kadar yararlı etkileri de bulunan uyuşturucu maddelerin, buyararlı etkileri göz önünde bulundurularak tamamen yasaklanması yoluna gidilmemiştir.Nitekim uyuşturucu, uyarıcı ve psikotrop maddeler, tıp ve ilaç biliminde geniş birkullanım alanına sahiptir. Bu faydalı kullanım amaçları doğrultusunda devletler, belirliruhsatlar dahilinde bu maddelerin imalinden, satışına ve kullanımına kadar ki tümeylemleri kontrol altına almaya yönelik sözleşmeler imzalamışlar ve bu sözleşmelere nederece uygun hareket edildiğini denetleyecek birçok uluslararası kuruluşlarkurmuşlardır. Türkiye’nin kendi egemenlik sahasındaki uyuşturucu madde suçlarıylamücadelesinin yasal alt yapısını ise 2313 sayılı Uyuşturucu Maddelerin MurakabesiHakkında Kanun, 3298 sayılı Uyuşturucu Maddelerle İlgili Kanun ve Türk CezaKanunu’nun ise 188 ve devamı maddeleri oluşturmaktadır.Tez çalışmamızın kapsamını Türk Ceza Kanunu’nun 188. maddesinin üçüncüfıkrasında düzenlenen ruhsatsız veya ruhsata aykırı olarak ülke içinde uyuşturucu veyauyarıcı madde satmak, satışa arz etmek, sevk etmek, nakletmek, satın almak, kabuletmek, başkalarına vermek, depolamak veya bulundurmak seçimlik hareketli suçlarıoluşturmaktadır. Bunun yanında uyuşturucu veya uyarıcı maddelerin ve buna ilişkinkavramların tanımlar, nitelikli haller, etkin pişmanlık ve yargılamaya ilişkin konularoluşturmaktadır.
Drug or stimulant trading crimes are one of the biggest problems encounteredglobally. The supply of drugs and stimulants, which are increasing day by day andaimed at meeting the demand for use, has led to the emergence of illegal trade. Drugs,which have beneficial effects as well as harmful effects, have not been completelybanned by taking these beneficial effects into consideration. As a matter of fact, drugs,stimulants, and psychotropic substances have a wide range of use in medicine andpharmaceutical science. In line with these beneficial uses, states have signed contractsto control all actions from the production, sale, and use of these substances withincertain licenses. However, many international organizations have been established toinspect whether these conventions are complied with. The legal infrastructure ofTurkey's, which fight with the drug-related crimes in their sovereignty, consists of theLaw on Inspection of Drugs No. 2313, Law No. 3298 on Narcotic Drugs, and the 188and follow-on articles of the Turkish Criminal Code.The scope of our thesis; Selling, offering for sale, consigning, transferring,purchasing, accepting, giving to others, storing or keeping drugs or stimulants in thecountry without a license or contrary to the license regulated in 3 paragraphs of 188Article of the Turkish Criminal Code, are crimes with an optional action (In thedefinition of the crime, it is the crimes where more than one action is shown as anoption and that doing any of them is sufficient for the crime to occur). In addition, thethesis includes the definitions of drug or stimulant substances and related concepts,qualified cases, effective repentance, and issues related to the judgment.
