Metropoliten alanlarda çocukların korunması, çocuk mahkemelerinin rolü ve bir model önerisi

Abstract

Kanun kapsamında suç olarak belirtilen eylemleri gerçekleştiren çocuklar, suça sürüklenen çocuklar şeklinde tanımlanmaktadır. Belirtilen eylemlerin mağduru da çocuk olduğu vakit hem korunması gereken hem de suça sürüklenen çocuk sayısı artmakta, yaşanan durumların iki taraflı mağduru da çocuklar olmaktadır.Çocuk suçluluğunu önleme ve cezalandırma sistemi ülkeleri en çok düşündüren bir konu haline gelmiştir. Bizim ülkemizde de bu konuda birçok çalışma yapılmasına rağmen, çocuk suçluluğuna yönelik adalet sistemi karışık bir vaziyettedir. Bu konuda çözüm önerileri sunulmasına rağmen, sistemin değişmesine yönelik ciddi adımlar atılmamaktadır.Bu çalışma; çocuk suçluluğunun ve rehabilitasyonunun metropoliten alanlardaki durumunu irdelemek, sorunları göz önüne sermek ve bu konuda yapılabileceklere yönelik bir model önerisi amacıyla yapılmıştır. Çalışma beş bölümden oluşmaktadır. Birinci bölümde metropoliten alan ile ilgili genel bilgilere yer verilmiş ve çocuk suçluluğuna ve rehabilitasyonuna yönelik yapılanlara değinilmiştir. İkinci bölümde çocuk ve çocuk suçluluğu kavramları irdelenmiştir. Üçüncü bölümde çocuk adalet sistemi ayrıntılı bir şekilde açıklanmıştır. Dördüncü bölümde çocuk suçluluğunda sosyal hizmetin işleyişine yönelik bilgiler sunulmuştur. Beşinci ve son bölümde ise metropoliten alanlarda çocuk suçluluğuyla ilgili bir model önerisi sunulmuştur. Sonuç olarak gerek metropoliten alanlarda gerek metropoliten alanlar dışında kalan yerlerde suça sürüklenen ya da hakkında tedbir kararı uygulanan çocuklarla ilgili var olan mevzuatın karmaşıklığı sorunları daha da arttıran bir durum ortaya çıkarmaktadır.

Children who commit the acts specified as crimes under the law are defined as children driven into crime. When the victim of the actions mentioned is a child, the number of children who need to be protected and who are driven to crime increases, and children are the bilateral victims of the situations experienced. Juvenile delinquency prevention and punishment system has become a top concern for countries. Although there are many studies on this subject in our country, the justice system for juvenile delinquency is in a mixed state. Although solutions are offered in this regard, serious steps are not taken to change the system. This work; It was made in order to examine the situation of juvenile delinquency and rehabilitation in metropolitan areas, to reveal the problems and to propose a model for what can be done in this regard. The study consists of five parts. In the first part, general information about the metropolitan area has been given and the actions regarding juvenile delinquency and rehabilitation are mentioned. In the second chapter, the concepts of juvenile and juvenile delinquency are examined. In the third part, the juvenile justice system is explained in detail. In the fourth chapter, information on the functioning of social work in juvenile delinquency is presented. In the fifth and last chapter, a model proposal on juvenile delinquency in metropolitan areas is presented. As a result, the complexity of the existing legislation regarding children who are dragged into crime in metropolitan areas and places outside of metropolitan areas or on whom cautionary orders are applied creates a situation that further increases the problems.
