Elektronik belgeler ve telif hakları

Abstract

Bu tezin amacı, elektronik belgelerin telif hakkını teknolojik ve yasal gelişmelere göre incelemektir. Bu yönde telif hakkı kapsamında olan ve olmayan belgelerin durumu irdelenmiştir. Bu amaçla tezin, birinci bölümünde telif hakkının tanımı ve tarihçesi, telif hakkı alanındaki uluslararası anlaşmalar, eser ve eser sahibinin hakları ele alınmıştır. Bu açıklamaların ardında, ikinci bölümde, elektronik belgenin tanımı ve türleri, elektronik belge yönetimi, belgenin yaşam döngüsü konularına değinilmiştir. Bunun dışında bilgi, belgve doküman yönetimi birbiriyle kıyaslanmıştır. Üçüncü bölümde ise önceki bölümlerden elde edilen bilgiler doğrultusunda elektronik belgelerin telifi olup olmadığıyla ilgili sonuçlar çıkartılmıştır. Ayrıca teknolojik gelişmelerin telif hakkı kapsamında olmayan belgelere de koruma getirebileceğiyle ilgili yorum yapılmıştır. Elektronik belgelerin telifi açısından, veri tabanları, internet ve web sayfaları konuları ele alınmıştır. Son olarak tezin dördüncü bölümünde çeşitli kurumlarda elektronik belgelerin telif hakkı uygulamaları incelenmiştir.

The purpose of the thesis is to study the the copyright of the electronic records according to the legal and technical developments. In this respect, the electronic records which presently qualify and do not qualify for protection under copyright law are reviewed. With this purpose, in the first part of the thesis, the brief history and the definition of copyright, the international arrangements with regard to copyright, the rights of work and creator are dealt with. Then in the second part of the thesis, the kinds and the definition of electronic record, electronic records management and life-cycle of records are reviewed. Also information management, electronic record management and document management are compared each other. In third part of the thesis, according to previous parts, whether electronic records are or not under copyright protection are reviewed. Internet, web sites and databases are dealt with in terms of the copyright of the electronic records. Finally, the forth of thesis, the applications related to the copyright of the electronic records in the different organizations are discussed.
