Abstract

Mecelle-i Ahkâm-ı Adliyye’nin (madde 101-madde 1095) çeviri yazısı ve günümüz Türkçesine çevirisinin hazırlanması Bu çalışma, Osmanlı hukuk sisteminin temel taşlarından biri olan Mecelle-i Ahkâm-ı Adliyye’nin 101. maddesinden 1095. maddesine kadar olan bölümünü çeviri yazı ve günümüz Türkçesine tercüme, elde edilen tarifleri derleyip sözlük oluşturmayı amaçlamaktadır. 19. yüzyılın ikinci yarısında Ahmed Cevdet Paşa’nın öncülüğünde hazırlanan Mecelle-i Ahkâm-ı Adliyye, İslam fıkhına dayalı olarak oluşturulan ve modern hukuk sistemlerine geçiş sürecinde bir köprü vazifesi gören ilk medeni kanun niteliğindedir. Araştırmada doküman inceleme yöntemiyle metin incelenmiş; çeviri yazı çalışmaları metnin asıl yapısına sadık kalınarak gerçekleştirilmiştir. Tercüme sürecinde ise hem anlam bütünlüğü hem de terimlerin bağlama uygunluğu gözetilmiştir. Araştırmanın temel amacı, Mecelle-i Ahkâm-ı Adliyye metninin özgün yapısını koruyarak, günümüz okurlarına anlaşılır biçimde sunmak ve bu tercümeyle hukuk, dil ve tarih alanlarına katkı sağlamaktır. Bunun yanı sıra çalışmada Mecelle’nin oluşum süreci, Ahmed Cevdet Paşa’nın rolü ve Mecelle Cemiyeti’nin yapısı gibi tarihî arka plan unsurları da ele alınmıştır. Bu yönüyle çalışma, hem Osmanlı hukuk literatürüne hem de Osmanlı Türkçesi metin çözümlemelerine yönelik bir katkı sunmayı hedeflemektedir.

Transcription of the work named “Mecelle-ı Ahkâm-ı Adliyye” (article 101-article 1095) and its linguistic examination by translating it into modern Turkish This study aims to transcribe and translate into contemporary Turkish the section of Mecelle-i Ahkâm-ı Adliyye covering Articles 101 to 1095, as well as to compile definitions extracted from the text to create a glossary. Prepared under the leadership of Ahmed Cevdet Pasha in the second half of the 19th century, the Mecelle-i Ahkâm-ı Adliyye is recognized as the first civil code based on Islamic jurisprudence and served as a bridge in the transition to modern legal systems. In this research, the text was analyzed using the document analysis method. The transcription process wass carried out with fidelity to the original structure of the text. During the translation phase, both semantic coherence and contextual approprianteness of the legal terms were carefully considered. The main objective of the study is to present the Mecelle-i Ahkâm-ı Adliyye in a clear and comprehensible format for contemporary readers while preserving its original form, thus contributing to the fields of law, language and history. In addition, the study addresses the historical background of the Mecelle, including ist formation process, the role of Ahmed Cevdet Pasha and the institutional structure of the Mecelle Commission. In this respect, the study aims to provide a contribution to Ottoman legal literature as well as to analytical approaches in the examination of Ottoman Turkish texts.
