Yargıtay Kararları Çerçevesinde Zamanaşımının İşlemeye Başlaması İçin Gerekli Koşullardan Olan “Zararın Öğrenilmesi” Olgusu (TBK m.72)(*)

Abstract

Zamanaşımının işlemeye başlaması için zararın öğrenilmesinden amaç, zarar verici olayı değil, zararın varlığı, niteliğive esaslı unsurları hakkında dava açmaya, bu davayı objektif şekilde desteklemeye ve davanın gerekçelerini göstermeyeelverişli, yeterli hak ve koşulların öğrenilmesi demektir. Bunlar öğrenilmedikçe, zarar gören dava yoluyla talepedebileceği tazminatın sebep ve şartlarını değerlendiremez. Zarar veya zarar verici fiil devam ettiği sürece zarargörenin zararı öğrendiği kabul edilemez.

The purpose of becoming aware of the loss in order for a statute of limitations to start refers not to the incident causing the loss but becoming aware of the rights and conditions adequate to file a lawsuit about the existence, attribution and essential components of the loss, to support this lawsuit objectively and to represent the grounds of the case. As long as these haven’t been found out the injured party cannot assess the causes and conditions of the damages those can be claimed by remedies. As long as the action causing the loss continues it cannot be accepted as the injured party is aware of the loss.
