Cüveynî ve Sem‘ânî’nin usûl anlayışlarının mukayesesi (nesih konusu örneği)

Abstract

Hicrî V. asır İslâmî ilimlerin diğer dalları için olduğu gibi fıkıh usûlü için de bir dönüm noktası olmuş, birçok önemli eser telif edilmiş ve mütekaddimûn dönemi sona ererek müteahhirûn dönemi başlamıştır. Fıkıh tarihinde böylesine önem arz eden hicrî V. asırda yaşamış Şâfiî mezhebine mensup iki müçtehit olan İmâmü’l-Haremeyn el-Cüveynî (ö.478/ 1085) ve Ebü’l-Muzaffer es-Sem‘ânî (ö.489/ 1096) fıkıh metodolojisi açısından birbirlerinden farklı tarzları yansıtmışlardır. Aynı fıkıh mezhebine mensup oldukları halde usûl anlayışlarında iki ayrı yaklaşım benimseyip usûlî meseleleri farklı metotlarla değerlendirmeye tabi tutmuşlardır. Cüveynî usûl-i fıkıh alanındaki meşhur eseri el-Burhân fî usûli’l-fıkh’ı Şâfiî mezhebinin genel tercihi olan mütekellimûn metodu ile kaleme alırken Sem‘ânî ise Kavâtı‘u’l-edille fi’l-usûl’ün mukaddimesinde de belirttiği üzere usûl-i fıkıh alanındaki bu eserini fukahâ metoduna bağlı kalarak yazmıştır. “Cüveynî ve Sem‘ânî’nin Usûl Anlayışlarının Mukayesesi (Nesih Konusu Örneği)” isimli bu tezde Şâfiî mezhebinin mühim simâlarından olan bu iki müçtehidin usûl anlayışları, el-Burhân ve Kavâtı‘u’l-edille isimli eserleri üzerinden, fıkıh tarihi boyunca hakkında birçok farklı görüş serdedilen nesih konusu özelinde mukayese edilecektir. Bu mukayese çalışması fıkıh usûlü literatüründe fukahâ metodunun “Hanefî metodu”, mütekellimûn metodunun ise “Şâfiî metodu” olarak anılması genel kanısını değerlendirmeye açacaktır.

Fifth century (a.h) was a turning point in uṣūl al-fiqh, as it was for other branches of Islamic sciences. So many important and illustrious works were written in this period and a new intellectual age has begun with these developments. Imâmü'l-Haremeyn el-Cüveynî and Ebu'l Muzaffer es-Sem'ânî are two important mujtahids belonging to the Shafi'i madhhab, who lived in the fifth century (a.h), reflected different styles from each other in thought of jurisprudence. Although they belonged the same madhhab, they adopted two different approaches in their understanding of uṣūl al-fiqh and evaluated the issues interested with uṣūl al-fiqh with different methods. While Cüveynî wrote his famous work in the field of uṣūl al-fiqh, al-Burhan fî usûli'l-fiqh, with the method of mutakallimûn, which is the general preference of the Shafii madhhab, As Sem’ânî states in introduction of Kavâtı‘u’l-edille fi’l-usûl, he wrote this work based on the method of fukahâ. In our thesis, the thoughts of uṣūl al-fiqh of these two mujtahids, who are one of the important figures in the development of the Shafi'i literature, will be examined through their works el-Burhân fî usûli’l-fıkh and Kavâti'ul-edille fi'l-usûl. In addition, the naskh part which has been given many different views throughout the history of fiqh, has been selected as an example section from the works named al-Burhân and Kavatı'u'l-edille fi'l-usûl, will be compared.
