Klasik dönemde kadı (hakim) maaşlarında izlenen politika ve uygulamalar

Abstract

Klasik Dönemde Kadı (Hakim) Maaşlarında İzlenen Politika ve Uygulamalar Yargı vazifesini yürüten hakimler İslam devletinde kamu görevlisi olarak kabul edilmiş ve ilk dönemlerden itibaren kendilerine belli bir maaş tahsis edilmiştir. İslam hukukuna ait eserlerde de hakimlerin maaş alıp alamayacağı konusunun çeşitli açılardan incelendiği görülmektedir. Hukukçular, ayrıca hakimin maaşının nereden karşılanacağı, yargı görevinin dışında özel birtakım işlerle meşgul olmasının cevazı, davaya taraf olanlardan ücret alıp alamayacağı gibi onların iktisadi durumuyla ilgili birçok meseleyi de ele alıp tartışmışlardır. Bu nazari arka planın yanında konunun uygulamayla ilgili yönüne baktığımızda hakimlerin maaşları dışında atâ, câize, gibi ek gelirlerinin bulunduğu bunun yanında onlara gıda, giyecek, binit gibi bazı yardımların yapıldığı tespit edilmektedir. Tezde bu ve buna benzer birtakım nazari ve tatbiki bilgileri bir araya getirerek İslam tarihinde hakimler için uygulanan maaş sistemi hakkında bilgi verilmeye çalışılmıştır. Policies and practices on the salaries of the judges (kadi) in the Classic Era In the Islamic state era, judges were given the status of civil servant and a fixed salary was allocated to them from the beginning. It is observed that works on Islamic law reviewed the issue of whether or not the judges were eligible for salary from various points of view. Lawyers also debated many other issues concerning the economic status of the judges, such as how to fund the salaries payable to the judges, whether or not the judges should be allowed to carry out private works in addition to their official position, and whether or not they should be allowed to receive a fee from the parties of the cases submitted to them. Review of the practical issues in addition to this theoretical background reveals that the judges were entitled to receive such additional incomes as gifts and endowments and such benefits as food, clothing and saddle horses. This thesis aims to gather the above mentioned and other theoretical and practical data in order to give information about the salary system applied for the judges in the history of Islam.
