Hanefi doktrininde ibadet ve ceza konularında kıyas yönteminin kullanılışı (Bedaiu’s-Sanai’ çerçevesinde)

Abstract

Bu çalışmada usûl eserlerinde kıyas yönteminin alanı ile ilgili olarak mezhep müctehidlerinden nakledilen görüşlere yer verildikten sonra furûda bu kurallara ne derece bağlı kalındığını belirleyebilmek gayesiyle Hanefî fıkhının temel eserlerinden olan Bedâi‘u’s-sanâi‘nin İbadet ve ceza bölümlerinde kıyas yönteminin kullanılıp kullanılmadığı araştırılmıştır. İbadet ve ceza konularında kıyası cârî görmedikleri, bununla beraber kendi usûl kurallarına furû eserlerinde bağlı kalmadıkları ve tenakuza düştükleri şeklinde özellikle Şafiîler tarafından şiddetli tenkitlere muhatap olan Hanefîlerin yaklaşımları değerlendirilmiş ve onların bu sözle asıl kasıtlarının ne olduğu ortaya konmaya çalışılmıştır. Tezimiz bir giriş ve iki bölümden oluşmaktadır. Giriş bölümünde genel olarak Kıyas yöntemi ele alınmıştır. Birinci bölümde kıyas yönteminin ibadet ve ceza konularına şâmil olup olmadığı noktasında zikredilen görüşler üzerinde durulmuştur. Çalışmamızın esas amacı olan ikinci bölümde ise Bedâi‘u’s-sanâi‘nin ibadet ve ceza bölümlerinde kıyas yöntemi, kullanıldığı anlam açısından taksimi esas alınarak örnekler üzerinde incelenmiştir.

In this study, after giving the opinions of “mezhep” scholars about the field of the analogy method in the “usûl” sources, in order to determine how much they were depended on the rules in “furû” it was investigated whether the comparison method was used in the chapters of worship and punishment (İbadet and Ceza) in Bedai‘, one of the fundamental sources of Hanafi school. The Hanafi approaches, which were subjected to severe criticisms by particularly the Shafiis in a sense that they view comparison is not “cari” in the subjects of worship and punishment (İbadet and Ceza) and in addition to this, they don’t depend on “furû” sources and fell under conflict, were discussed and it was tried to put forward what they really meant with this perception. This thesis is composed of an introduction part and two sections. In the introduction part, generally, the analogy (qıyas) method was handled. In the first chapter, the opinions about whether the analogy (qıyas) method is inclusive or not for the subjects of worship and punishment (İbadet ve Ceza) were discussed. In the second chapter, which is the main purpose of the study, the analogy (qıyas) method in the chapters of worship and punishment (İbadet and Ceza) in “Bedai” was investigated in terms of the meanings they were used for through samples based on partition.
