Abstract
İŞVERENİN KORUMA VE GÖZETME BORCU KAPSAMINDA İŞÇİLERE BİLGİ VERME YÜKÜMLÜLÜĞÜ Günümüzde teknolojinin gelişmesi ve dijitalleşmenin toplum hayatına etkisi çalışma hayatını da derinden etkilemiştir. Bu etki işçi-işveren ilişkisinde bilgilenme hakkının da önemi git gide arttırmaktadır. Bu bakımdan, işverenin koruma ve gözetme borcu kapsamında işçilere bilgi verme yükümlülüğü, işçinin temel hak ve özgürlüklerinin korunması ve işverenin yönetim yetkisinin sınırlanması bağlamında da büyük önem arz etmektedir. Tezimizde öncelikle işverenin koruma ve gözetme borcu kapsamında değerlendirdiğimiz bilgi verme yükümlülüğünün hukuki içeriğinin belirlenebilmesi amacıyla koruma ve gözetme borcunun kapsamı ve sınırları incelenmiştir. İşçinin bilgilenme hakkı ile işverenin koruma ve gözetme borcu arasındaki ilişki ele alınmıştır. Hukukumuzda, işverenin bilgi verme yükümlülüğünü doğrudan düzenleyen hükümler sıklıkla rastlanmasa da bu konu olması gereken hukuk bakımından ve AB mevzuatı çerçevesinde ele alınmıştır. Bu bakımdan, işverenin bilgi verme yükümlülüğü, iş hukukunun konusunu oluşturan birçok başlık altında kendisine yer bulmaktadır. Bu yükümlülük bazı durumlarda işçiye yalnızca bireysel olarak yerine getirilmekte; bazı durumlarda ise kolektif bir nitelik taşımaktadır. Tezimizde işverenin bilgi verme yükümlülüğü işyerinde sosyal diyaloğun bir türü olarak ve işverenin aydınlatma borcu kapsamında olmak üzere iki ayrı başlık altında incelenmiştir.
OBLIGATION OF THE EMPLOYER TO INFORM EMPLOYEES WITHIN THE SCOPE OF PROTECTION AND OVERSIGHT Today, the development of technology and the impact of digitalization on social life have also deeply affected working life. This effect increases the importance of the right to be informed in the employee-employer relationship. In this respect, the employer's obligation to inform the workers within the scope of the duty of protection and surveillance is of great importance in the context of protecting the fundamental rights and freedoms of the workers and limiting the management authority of the employer. In our thesis, first of all, the scope and limits of the duty of protection and oversight were examined in order to determine the legal content of the obligation to provide information, which we evaluated within the scope of the employer's duty of protection and supervision. The relationship between the employee's right to be informed and the employer's duty of protection and oversight is discussed. In our law, although the provisions that directly regulate the employer's obligation to provide information are not frequently encountered, this issue has been handled in terms of law and within the framework of EU legislation. In this respect, the employer's obligation to provide information takes place under many titles that constitute the subject of labor law. In some cases, this obligation is only fulfilled individually; in some cases it has a collective character. In our thesis, the employer's obligation to provide information has been examined under two separate headings, as a type of social dialogue in the workplace and within the scope of the employer's obligation to clarification.
