Ebu’l-Leys Semerkandi’nin Nevazil’i ışığında sosyal olgu fetva ilişkisi

Abstract

EBU'L-LEYS ES-SEMERKANDİ'NİN NEVÂZİL'İ IŞIĞINDA SOSYAL OLGU-FETVA İLİŞKİSİ Ebu'l-Leys es-Semerkandî, Sâmân Oğullarının hüküm sürdüğü Horâsân ve Mâverâünnehr ilim ve kültür havzasında yaşamış, 373/ 983'te muhtemelen doğduğu Semerkant şehrinde vefât etmiştir. Semerkandî gerek görüşleri, gerekse kaleme aldığı eserleriyle Hanefi mezhebine önemli katkılarda bulunmuş çok yönlü bir ilim adamıdır. Semerkandî, Kitâbu'n-Nevâzil'de, içtihat ve tahriç yoluyla elde ettiği hükümler kadar yaptığı önemli tercihleriyle de ön plana çıkmıştır. Nevâzil boyunca Ebu'l-Leys füru fıkhına ait çeşitli konularda hem mezhep imamına hem de önde gelen fakîhlerin görüşlerinin aksine içtihatlarda bulunduğu gözlemlenmiştir. Semerkandî, tercihlerini yaparken daha çok kendi yöresinde bulunan âlimlerin görüşlerini aldığı tarafımızca tespit edilmiştir. Buradan Ebu'l-Ley es-Semerkandî'nin fetva verirken, içinde doğup büyüdüğü Horâsân ve Mâverâünnehr örfünden etkilendiğini, tercihlerinde de kendi toplumunu, toplumun sosyolojik boyutunu, daha yakından tanıyan fakîhlerin görüşlerini aldığını müşâhede etmekteyiz. THE RELATIONSHIP BETWEEN SOCIAL REALITY AND FATWA IN THE LIGHT OF ABU AL LAYS AL-SAMARKANDI'S NAWAZIL Ebu Al-Lays AL-Samarkandi lived in region of science and culture, named Horasan and Mavaraunnehr where Saman Oğulları prevailed, died in 373/ 983 Samarkand that may his birtplace. Samarkandi is a sophisticated scientist who contributed to sect of Hanafi with his opinion and works. İn the work of Nawazil, Samarkandi became popular through his significant preferance as well as his provisions the help of doctine and tahric.İt is observed that in the work of Nawazil Ebu Al-Lays AL-Samarkandi has made some interpretation which are in contrast to point of both sect leader and famous İslamic Lawyers.We have also observed that while making preferance refered to point of viewer of scientist mostly lived in the same territory together. İn tehe light of these knowledge we realize that while making fatwa he has been affected from the common usage of Horasan and Mavaraunnehr where he grown up and in his preferance he has recouraged to opinion of İslamic Lawyers who recognize his society and structure of society better.
