ÖZET MESLEKİ ETİK KAPSAMINDA BASININ ADİL YARGILANMA HAKKI İLKESİNE YAKLAŞIMI Özellikle 2007 yılından sonra basında gündeme gelmeye başlayan soruşturmalar ve soruşturmaya uğrayan kişilerle ilgili haberler, etik ilkeler, adil yargılanma hakkı ve basın özgürlüğü konularında tartışmalara neden olmuştur. Bu çalışmada, basını temsilen seçilen, Zaman ve Hürriyet gazetelerinde yer alan Ergenekon Soruşturması konulu metinlerin, etik ilkelere ve adil yargılanma hakkı ilkesine uygunluğu, seçilen örneklem kapsamında araştırılmıştır. Bunun için öncelikle adil yargılanma hakkının ifade biçimleri incelenmiştir. Ayrıca, bu hakkın basında yer almaması durumunda ortaya çıkabilecek sonuçlar tartışılmıştır. Dolayısıyla basın özgürlüğünü sınırlayan konulardan birisi adil yargılanma hakkıdır. Basın, yasalarla sahip olduğu özgürlük hakkını etik ilkeleri ve adil yargılanma hakkını gözeterek değerlendirmelidir. THE APPROACH OF PRINT MEDIA TOWARDS THE RIGHT TO A FAIR TRIAL IN TERMS OF PROFESSIONAL ETHICS The inquiries began to come to the agenda, especially after 2007 in the press and news about people who suffered the investigation of ethical principles, the right to a fair trial and freedom of the press has led to debate issues. In this study, we elected to represent the press, newspapers, Time and Freedom on the texts of the Ergenekon investigation, compliance with ethical principles and the principle of the right to a fair trial, investigated the scope of the selected sample. First of all forms of expression were of the right to a fair trial. In addition, the results that may arise in the absence of this right are discussed in the press. Therefore, one of the issues that limit the freedom of the press has the right to a fair trial. The press freedom by law has the right to evaluate the ethical principles and respecting the right to a fair trial.
