Publication: Uluslararası sözleşmeler ve yargı kararları ışığında Türk iş hukukunda toplu eylem hakkı
Abstract
İfade özgürlüğünün İş Hukukundaki kollektif görünümü biçimi, demokratiktoplum olmanın bir gereği olarak kabulü gereken bir insan hakkı olan toplu eylem hakkı,işçilerin ekonomik, sosyal ve çalışma menfaatlerini ilgilendiren durumlara karşıkullandıkları bir direnme hakkıdır. İlk olarak Avrupa Sosyal Şartı'nın, Türkiye tarafındançekince konulmuş 6. maddesinde grev de dahil toplu eylem hakkı denilmek suretiyleüst bir kavram niteliğinde olduğu vurgulanarak ifade bulmuştur. Sendikal haklarınbütünselliği ilkesi gereği, toplu eylem hakkı işçilere tanınmadan, işçilerin menfaatlerinintam anlamıyla korunacağından söz etmek mümkün olmayacaktır. Toplu eylem hakkıişçilere özgü bir hak olarak düşünülse de, Avrupa Sosyal Şartı düzenlemesindenişverenlerin de toplu eylem hakkı olduğu, işverenlerin toplu eylem hakkını lokavt olarakkullandığı ifade edilmektedir. Hukuki temelleri uluslararası normlar, denetim ve yargıorganı kararları olan toplu eylem hakkı, Türk İş hukukunda, Anayasa m.90/ 5düzenlemesiyle iç hukukla çatışma halinde olan uluslararası hukukun esas alınmasınınemredilmesi sebebiyle, Yargıtay kararlarıyla yakın zamanda kabul edilmeye başlanmıştır.Çalışmamızda toplu eylem hakkı, uluslararası normlar ve kararlarla Türk iç hukukundakidüzenlemeler kıyaslanarak, yargı kararları ışığında ele alınmaktadır.
The collective view of freedom of expression in Labor Law, right of collectiveaction which should be recognized as a necessity of being a democratic society, is a rightof resistance used by workers against situations that concern their economic, social andwork interests. First of all, in the 6th article of the European Social Charter, in whichTurkey made a reservation, it has been emphasized that it is a superior concept by sayingcollective action right including strike. Due to the principle of the integrity of unionrights, it will not be possible to talk about the full protection of the interests of workerswithout the right to collective action. Although collective action right is considered as aright specific to workers, It is stated in the regulation of the European Social Charter thatemployers also have the right to collective action and employers use the collective actionright as a lockout. The right to collective action, whose legal foundations are internationalnorms, inspection and judicial decisions, has been recently started to be accepted with thedecisions of the Supreme Court, due to the order in Turkish labor law to be based oninternational law, which is in conflict with domestic law (with the regulation art.90/ 5 ofthe Constitution). In our study, the collective action right is discussed in the light ofjudicial decisions by comparing international norms and decisions with the regulations inTurkish domestic law.
