Çağımızda ifta usulü

Abstract

TEZ ÖZETİ Biz bu çalışmamızı giriş ve çağımızda ifta usulü olmak üzere iki kısma ayırdık. Giriş bölümünde konu ile ilgili önemli birkaç terimin açıklamasını yaptıktan sonra ifta usulü probleminin ortaya çıkış zamanını ve böyle bir problemin doğmasına sebep olan faktörleri tespit etmeye çalıştık. Bu amaçla Hz. Peygamber döneminden başlayarak sırasıyla sahabe, tabiun, tebeüttabiun, duraklama ve kanunlaştırma dönemlerini ana hatlarıyla ele aldık. Klasik dönemde uygulanan ifta usulünü tespit edebilmek için öncelikle mezheplerin benimsedikleri fukaha tabakatını naklettik daha sonra da müctehid, muharic ve mukallid tabakasına mensup bulunan fakihlerin fetva verirken uyguladıkları usulü ayrı ayrı belirttik. Konunun sonunda da yukarıda bahsettiğimiz her üç tabakaya mensup fakihlerin ifta kaynaklarını zikrettik. Bu bilgileri arz ettikten sonra çağımızda uygulanan ifta usulünü ele aldık. Konunun genişliği sebebiyle sadece Cumhuriyetin ilanından sonra Türkiye'de uygulanan ifta usulünü tespit ettik. Çağımızdaki ifta usulünü ortaya çıkarabilmek için önce fetva verenlerde, fetva isteyenlerde ve fetvaya konu olan meselelerde meydana gelen değişiklikleri sebepleri ile birlikte açıkladık. Daha sonra günümüzde fetva veren birkaç fakihin uyguladığı ifta usulünü ve son dönemlerde yazılmış ifta kaynaklarını tespit ettik.

Literally, fatwa is derived from the root fata, which includes in its semantic field the meanings youth, newness, clarification. The technical usage of the term fatwa became more specific, after the compilation of legal literature by the different schools, the term fatwa was used for the cases not covered in the fıqh (law) books. The act of giving a fatwa is a futya or ifta, the person who gives a fatwa or is engaged in that profession is a mufti; the person who asks for a fatwa is a mustafti. The thesis includes two chapters. The first chapter is entrance, the second chapter is the method of fatwa in our century. In the first chapter there are meanings of important terms and appearance of method of fatwa problem. Accordingly I mentioned periods of The Prophet, Sahabe, Tabiun, Tebeuttabıun, Discontinuance, Legislate. I explained the degree of fukaha that is Mujtahid- Muharric- Muqallid. Afterwards I discussed method of fatwa in our century. I explained the differences of the mufti and mustefti and matters' fatwa in our century for discovering the method of fatwa in our century and then I explained the sources of fatwa.
