İŞÇİNİN ARDI ARDINA İKİ İŞGÜNÜ DEVAMSIZLIĞI (YARGITAY KARARI TAHLİLİ)

Abstract

Yargıtay,12.03.2012 tarihli kararında, Kanunun m. 25/II (g) bendinde yer alan ardı ardına iki işgünü devamsızlık düzenlemesini, farklı şekilde yorumlayarak, işçinin devamsızlık yaptığı işgünlerinin arasına, işe gelmesinin beklenmediği/gerekmediği başka günlerin girmesi halinde dahi, devamsızlığın ardı ardına olduğunu kabul ederek iş sözleşmesinin işveren tarafından haklı nedenle feshedilebileceği yönünde karar vermiştir. Kanaatimizce, Kanun hükmünün lafzı ve ruhu birlikte değerlendirildiğinde, bu tür durumlarda ardı ardına devamsızlıktan söz edilemez ve işçinin iş sözleşmesi ardı ardına iki işgünü devamsızlık gerekçesiyle haklı nedenle feshedilemez.

The Court of Appeals has decided at 03.12.2012 that the labor contract may be terminated as per Article 25/II,(g) regulating just cause in case of two days consecutive absence by the employer, even though there are days on which the employee is not obliged to come to the working place between the days that the employee is absent. In our opinion, when the letter and spirit of the law considered together, in such cases there cannot be consecutive absence and the employee s labor contract cannot be terminated with just cause by the employer resulting from two working days consecutive absence.
