ÖZET İŞ KAZASI KAVRAMI VE SONUÇLARI İş kazası işçinin işyerinde veya işverenin gözetimi altında bulunduğu sırada dış sebeple ve aniden meydana gelen bir olay sonucu işçiyi bedence veya ruhça özre uğratan olaydır. İş kazaları çalışma hayatının en önemli konularından olup sadece kaza geçiren işçiyi değil beraberinde işçinin yakınları ile işveren ve toplumu da etkilemektedir. Kaza sonucunda geçici - sürekli iş göremezlik veya ölüm gerçekleşebilmektedir. Bunun neticesinde işçiye sağlık yardımlarının yanı sıra parasal yardımlar yapılmakta, işçi ve ailesine koşulları oluştuğunda tazminatlar ödenmektedir. Tüm bunlar birlikte değerlendirildiğinde iş kazalarının işçi ve işverenler açısından ciddi sonuçlar doğurduğu aşikar olup iş kazalarının önlenmesi için ilgili yasal düzenlemeler çerçevesinde gerekli önlemler alınmalı ve denetimler yapılarak tarafların buna uyup uymadıkları kontrol edilmelidir. Bu çalışmamda iş kazasının tanımı Sosyal Güvenlik Hukuku ile İş Hukuku anlamında ayrıntılı olarak incelenmiş sonra iş kazasının hukuki sonuçları ile sigortalıya ve sigortalının ölümü halinde hak sahiplerine yapılacak yardımlar kapsamlı olarak incelenmiş ve son olarak da iş kazalarının sonucu olan tazminatlar açıklanmıştır. OCCUPATIONAL ACCIDENT AND CONSEQUENCES Occupational accident is the incident which occurs all of a sudden due to external factors at the workplace of the worker or at a time when the worker is under the supervision of the employer, and causes physical damage and spiritual disability to the worker. While the occupational accident is one of the most important issues of the working life, it affects not only the worker himself/ herself, but the relatives of the worker, employer and the society as well. As a result of the accidents, the workers may sometimes lose their lives or suffer from temporary or permanent incapacity. If they survive, they are provided with health aids and monetary contributions, and a relevant amount of compensation is paid to the worker and his/ her family if the incident satisfies certain conditions. Considering all of these aspects together, it can clearly be stated that the occupational accidents may result in grave consequences for both employees and employers, and thus, necessary preventive measures should be taken within the framework of the relevant legal regulations and the prospective actors of these incidents should be inspected to check whether they duly take account of these measures. In this study, after the definition of the occupational accident is thoroughly analyzed in terms of Social Security Law and Labour Law, the legal consequences of the occupational accidents and the contributions to be made to the insured worker and his/ her beneficiaries in case of his/ her death will be comprehensively studied, and the compensations that are the result of the occupational accidents explained
